LAUSD Teachers Cannot Stand Up Without A Strong And Independent UTLA - Part 2 (Los maestros del LAUSD no pueden hacer frente sin una UTLA fuerte e independiente)

(Mensaje se repite en Español) As a matter of law, anybody charged with a crime or civil liability would be presumed innocent until proven guilt beyond a reasonable doubt in a criminal case and by a preponderance of the evidence in a civil matter. At LAUSD this is not the case. Next month, LAUSD will be able to have me dismissed as a teacher without even minimally authenticated evidence and without having done any due diligence that would have clearly shown that I literally have done nothing wrong.

While this would seem to violate my civil rights and should reasonable be the subject of legal action in my defense supported by UTLA, the union I have paid more than $57 a month to has been reticent to say the least in the past to vigorously advocate legally on behalf of presently and longstanding terrorized teachers within LAUSD.

The engine driving LAUSD administrative harassment of teachers is the fact that administrators up until now have faced no consequences for harassing teachers to the point of their actions qualifying as a criminal conspiracy that not only fabricates testimony, but also offers witnesses incentives if they are willing to perjure themselves in LAUSD's mindless campaign to get rid of any teacher willing to stand up for the educational values that could truly reform public education at LAUSD. These administrators continue to go into retirement with no personal responsibility for their illegal actions in violation of teachers civil rights and at worst leave a financially strapped LAUSD holding the bag for any future liability in the unlikely event that the harassed teacher's rights should ultimately be vindicated in the judicial system.

In the Janis Adams vs. LAUSD case, where a jury initially awarded sexually harassed teacher Janis Adams $4.5 million while sustaining all 5 separate counts of the case, the judge vacated the award while saying, according to another woman who wrote a book about the case, that any woman teacher should reasonably expect to be sexually harassed if she became a teacher. Ten years later, after LAUSD had spent $1.2 million in legal fees at the expense of California taxpayers, Ms. Adams received a small settlement that required her to sign a confidentiality agreement not to disclose the terms of her settlement.

In my own case, after my dismissal from LAUSD next month, I will be entitled to the first legal forum outside of pro forma and predetermined LAUSD process against me up until now. I will be entitled to discover of information that up until now LAUSD has refused to supply. I will also have a settlement conference where LAUSD might offer me something minimal if I just go away and sign a confidentiality agreement like Ms. Adams. However in my case I don't think this is likely, because I continue pissing them off by my refusal to shut up.

It is worth noting that once I am fired by the LAUSD Board, I will not be entitled to unemployment insurance and in the unlikely eventuality that I am able to find another job, LAUSD will claim an offset of any subsequent obligation they might have to pay me my salary if I ultimately vindicate my rights. Although Education Code Section 44939 clearly gives me a right to continue to be paid while appealing my dismissal if I post a bond to assure repayment of salary and benefits to the District if I ultimately loose on appeal, presently nobody in California writes such a bond, so I would effectively be without any income while fighting to vindicate my rights. How many teachers can afford to do that on their own? Yes, clearly LAUSD strategy is to starve you out and get you to accept a meager settlement to get this unsustainable stress out of your life.

However, you must be aware of several things. Although clearly CTC knows what LAUSD is up to and will not take your credential, once you have been tainted by this process, there is not a school district in the country that will touch a teacher who has been charged with a morals violation of downloading pornography in class whether or not it is true. Your career is over.

Furthermore, even if you win and are placed back in the classroom, the harassment will start all over again with administrators at your new assignment starting the whole process again to fabricate new evidence against you to again seek your dismissal.

When you ask the question who has the potential power to change this system, the answer is clearly UTLA, which presently gives this dishonest process by LAUSD credibility by taking part in grievances, arbitrations, and dismissals that they are in the unique position of knowing are completely unjustified in the majority of cases it sees. But UTLA up until now has remained silent and allowed its members to be savaged by LAUSD.

It is not too late for UTLA to finally become the uncompromising professional union advocate for its members under siege, instead of the long deferential punching bag of LAUSD. In so doing, it would create the antidote to the apathy that presently infects rank and file as to the hopelessness of standing up to LAUSD.

Clearly, LAUSD is so brutal in its unwarranted attacks on teachers like myself because it knows that if the teacher majority ever realized it dormant power and majority status, LAUSD as presently constituted would fall like a house of cards.

I’m back and angrier than ever (and hiding under seven layers of encryption).

I am most concerned about UTLA’s reaction to this situation and many other similar ones I’ve read or heard about--beleaguered teachers ignored or brushed off by UTLA.

The aim and goal of the LAUSD is to terrorize teachers and has been since its inception.

Was not UTLA formed to address this terrorization? Is this not what our dues are for? For the union that WE fund to promote, advocate and most importantly defend us teachers against the LAUSD’s arbitrary terror?

Our union has sold us out.

This is how the union in NY advocates for its teachers:

The city has decided to not release teacher performance grades before late November, hours after the teacher's union filed suit in New York City Supreme Court to prevent the release of such data.

I heard Duffy speak this past week--tell us teachers what the LAUSD has planned for us next year--at least 10 furlough days, a percentage of our salary, a payroll deduction for our health care, larger class sizes--with promises of even more, harsher cuts in the future.

Meanwhile, the government is hell-bent on ‘union busting’--breaking the Collective Bargaining agreement, ending seniority rights, breaking tenure, implementing subjective merit pay--in other words, putting all power and decision-making in the hands of the Central Office.

The Old Soviet Bosses would be proud!

It seems the government, advocacy groups such as the ACLU and our very own teachers’ union, UTLA are working together to triangulate against us.

Their goal is to reduce salary costs and health benefits for ‘over-paid’ teachers, to replace us with easy to fire interns, Teach for America-types, or H-1B visa holders from foreign countries--those easy to manipulate and fire, least likely to band together to form an advocacy group such as what UTLA is supposed to be. And most importantly, to keep salary costs way down.

I have seen no evidence that this is not the case; if I am wrong, please present proof that the situation is otherwise--that UTLA defends teachers, up to and including in front of a judge in court, that LAUSD isn’t trying to remove and/or revoke our seniority and judge us via students’ test scores, the government isn’t trying to implement merit pay and eliminate tenure (in order to fire us)

If I were in this situation, assigned to a rubber room, I would hire an outside lawyer, even if I had to mortgage my house and pension twice over--I would find someone who would advocate for me, familiar with educational law---someone who would not work hand-in-hand with the LAUSD or ignore me, such as UTLA
