Unless you're a member of the Los Angeles Unified School District (LAUSD) teaching community,  you probably didn't know that round one of the elections for offices within the United Teachers of Los Angeles (UTLA) union has come and gone and round two comes to a conclusion March 29 between the two surviving virtually indistinguishable runoff slates to decide the remaining offices.  However, even if you're a member of the teaching community, you may not know of these events, given that estimates of the voter turnout ran as low as 15% and no higher than 17%.  Pretty sorry for the second largest teacher's union in the country.  At some school sites, teachers didn't even know there was an election, and if they did, they couldn't identify the candidates much less separate them by their positions on issues.  But even if you're not a teacher, Keep this in mind.  What happens here will dramatically effect all teachers, public education and you by transference.  So read on if you want to know what's really going on.

This election has already been described as a landmark election given the challenges that public education faces and the huge reductions in school site teaching staffs.  There has never been such an election held when the level of threat was so high.  However, and very unfortunately, there has never been a UTLA election in which corruption and cheating are so rampant from the top end to smallest quarters which usually go unnoticed.

Let's start with the major players:

The major slates are headed by Julie Washington, a current vice president and Warren Fletcher, a man active in union circles for about the past two decades. Both are definite insiders although the Fletcher camp likes to play down such status.  The rest of the candidates were rounded out by Mat Taylor, another long time union activist and the only other full slate was SAVE, headed by Linda Everhart, a longtime activist for substitute teacher issues within the district and the union.  After that, there was a smattering of lesser known candidates for various offices running separately and most distinguished by a bid for the presidency carried on by David R. Garcia.

Now you may or may not have known a significant share of this.  However, here's what you probably don't know but should.  Prepare yourself for the worst because everything you're about to read constitutes a blatant violation of election rules. To start, several individuals running for offices staged false candidacies so that they could use their allotted space within the United Teachers newspaper to promote other candidates most notably Leonard Segal, a false candidate for president, along with Hal Wolkowitz, Debbie Walsh, Greg Russel, Elizabeth Luna, and Mark Seigle. Another issue here is that these false candidates drew votes away from true candidates.  Incumbents running for offices were also allowed to make multiple robo calls using union resources which constitutes and unfair advantage. 

These two violations alone should have merited the cancellation of the election process and the disqualification of all candidates who participated in the violations.  Furthermore, a significant part of the reason for the low voter turnout was due to ballots not having been supplied to a considerable number of schools. 

Add to that some candidates and most outstandingly Mat Taylor never saw their flyers delivered to schools sites for distribution. 

You may be asking yourself why didn't anyone file a complaint or ask for an investigation.  The answer to that is they did.  Francisco Martinez, a SAVE slate candidate for Secondary Vice President and David R. Garcia, a candidate for Union President both requested inquiries into violations and irregularities.  Mr. Martinez was told that his complaints could only address the office for which he ran.  Mr.Garcia was in general ignored. It should also be strongly noted here that only the SAVE slate and Mr.Garcia held the district and union equally responsible for the plight of education and the teaching profession.  I have included the full length of their requests at the end of this first installment.  But the truth is that the election committee knew  that these were violations and failed to act.  In fact, Warren Fletcher, who remains a runoff candidate for president, sat on the election committee during the last election and failed to reject the false candidacy that Leonard Segal ran in his favor or demand any investigations. To make matters even worse, early into the election, Fletcher made a devil's handshake agreement with Julie Washington that, if he should prevail, he would retain her as a negotiator.  So whether or not she prevails, she still holds on to a high paying position where she has already failed to prove her competence. Makes one wonder what deals were made.  The bottom line here is that if this is representative of how we run an election, how can we expect leadership to be worthy of respect and in turn to respect us as teachers or  public education as an institution? We need to reject the premise of the choosing between the better of two evils. There can be no such choice when both are equally odious.  To quote from Virgil:

SUBJECT: Contesting election results based on possible election rules violations and acts of fraud

1. Note from United Teacher Newspaper: "President, Vice-President, Elementary-Vice President, Secondary-Vice President, Secretary, Treasurer, and Board of Directors may submit an article for Election Supplement which shall be published indicating each candidate and the position they are seeking..."
According to the Election Rules:  every candidate was supposed to submit an article that would be published on the United Teachers newspaper.  The Election Rules clearly stipulate that this article shall be published indicating "each" candidate and the position they are seeking. Nowhere in the Election Rules does it indicate that this space shall include endorsements or the advertising for existing or non-existing candidates.
Word Definition: Each:
a. Each as an -adjective: every one of two or more considered individually or one by one: each stone in a building; a hallway with a door at each end.
b. Each as a-pronoun: every one individually; each one: Each had a different solution to the problem.
c. Each as an-adverb: to, from, or for each; apiece: They cost a dollar each.
Violation: Some Candidates   were using the UT(United Teachers Newspaper) space provided to advertise multiple times for other candidates and also to advertise for multiple candidates  rather than using the space provided for (each candidate) i.e. only for themselves as candidates as the Election Rules stipulate.

2. Election Rules stipulate on numeral II., Election Committee, the following: "...members of the Election Committee shall conduct themselves in a nonpartisan fashion, keeping in mind at all times the best interest of the UTLA and shall at all times endeavor to ensure that UTLA elections are conducted in a manner that provides no unfair advantage to any candidate and encourages the full participation of the membership in the election process.
Violation 1: Incumbents were allowed to conduct multiple robo-calls to inform the membership of issues that implied accomplishments for the incumbents and, as result, giving them a clear advantage over the rest of the candidates when it is clear that the voters would associate those accomplishments directly to the candidate doing the robo-call. Candidate Julie Washington, Betty Forrester and others were making robo-calls that could have been simply done by non-running individuals.
Violation 2: Substitute Alternative Voice for Education introduced a motion to the Substitute Committee that would have guaranteed funding for all candidates running for city wide offices with insufficient funding. The motion passed by unanimous vote and was later handed over to Betty Forrester to be introduced for a final vote in the House of Representatives' regular meeting. The motion was never introduced and was never heard by the HOR, violating the processes that the Constitution mandates.  The motion was never voted on and impeded candidates from getting the minimum funding to run a decent campaign.


3. The Election Manual states the following: "The Election Committee shall have the authority to supervise the conduct of the election in a manner that is consistent with this manual and the UTLA constitution.
Violation: The Election Committee should immediately have canceled the election process or have suspended candidates from running for office until a thorough investigation had been done with regard to the use of UT space to promote candidates other than the candidate's name listed on the corresponding space.


4. The Election Committee should declare elections null until a thorough investigation has been done with regard to why the number of voters on this election was so low. It's been published that only 17% of the membership voted. These results show more than just apathy. In order to have these elections validated, a complete investigation needs to be done immediately.
Violation: Teachers at multiple sites claimed that they never received a ballot and, as a result, were not able to vote in the City Wide Elections.


5. Candidate Matt Taylor had 13,000 fliers that never reached their appropriate destinations.
Violation: Matt Taylor's 13,000 fliers were never sent out to teachers. This impeded the candidate from reaching teachers that could have voted for him in this election.


6. Fake Candidates on the Special Edition of the United Teachers Newspaper and on the Election ballots. Disenfranchisement of voters.
Violation #1: Act of fraud committed when fake candidates were published by the UT newspaper and also printed on the ballots. The following candidates were presumably loaning their names to be placed on the UT and the ballots without actually being real running candidates: Hal Wolkovitz, Debbie Walsh, Greg Russel, Elizabeth Luna, and Mark Seigle.  An in depth investigation is required. Each of these fake candidates took a large percentage of votes away from real candidates and, therefore, disenfranchising many voters from their right to elect their leaders.  As a result, many voters were cheated into believing that their vote would count in this election when in reality their vote  went to a non-existing candidate. This act of fraud is even more obvious taking into account that none of these fake candidate's pictures were printed on the ballots and the United Teachers newspaper.

 
Election for UTLA President
Violation #1 : Leonard Segal received 194 votes, 3.14% of  votes that otherwise would have gone to any of the other legitimate candidates running for UTLA president;


Election for UTLA NEA Vice-president
Violation #2: Hal Wolkowitz received 517 votes, 12.89%  of  votes that otherwise would have gone to any of the other legitimate candidates running for UTLA NEA Vice-president;


Election for Elementary Vice-president
Violation #3: Debbie Walsh received 669 votes, 12.20% of votes that otherwise would have gone to any other legitimate candidate running for Elementary Vice-President;


Election for Secondary Vice-president
Violation #4: Greg Russel received 575 votes,  10.34% of votes that otherwise would have gone to any other legitimate candidates running for Secondary Vice-President;


Election for Treasurer
Violation #5: Elizabeth Luna received 387 votes, 6.69% of votes that otherwise would have gone to any other legitimate candidates running for Treasurer;


Violation #6: Mark Seigle received 119 votes, 2.14% of votes that otherwise would have gone to any other legitimate candidates running for Secretary;


Violation #7: Jeffrey E. Starr received  119 votes, 2.14% of votes that otherwise would have gone to any other  legitimate candidates running for Secretary;


Violation #9: Nora Lohmann  published on UT but was not on ballots.


7. Flyers printed on glossy paper
Violation: All fliers should have been printed on plain paper 20 pounds. Julie's flyers were printed on laminated glossy paper which make it heavier than twenty pounds paper stock. This violates the rule of twenty pounds.

My name is David R Garcia, I am a High school teacher in the Los Angeles Unified School district who would like to request an investigation or inquiry against the mismanagement of the Los Angeles Teacher's Union (UTLA).

The leadership of the Los Angeles Teacher's Union has ignored several of my requests to examine possible infractions which may have occurred during this past February Officer's elections.

The officers of UTLA may have withheld contact information of the candidates running for UTLA officer positions against the incumbents, while these same incumbents made themselves accessible to local media, the press and (in fact) made several automated phone calls which is, a violation of the campaign rules.

A violation of our own membership's constitution, they may have also employed non-union labor in their business practices.

I urge you, PLEASE help resolve this matter, as the Los Angeles Teacher's Union is the last bastion of hope against the corporate takeover of our public schools... our organization needs to be held accountable, be objective, and reflect the highest integrity of its members.

Susan Lee Schwartz Suffern, New York

Susan studied literacy education, English literature, and fine arts and holds a BA ('63) and MS ('65) from Brooklyn College, and has the equivalent of two master's degrees, earned in graduate studies of literacy, arts and education. She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. At the end of her research, her unique curriculum was selected by the LRDC to be used in their national staff development seminars for school superintendents. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. In the nineties, she rose to prominence in national educational circles, while teaching at a new magnet school, East Side Middle School. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. Her essay here on Perdaily,  is one that describes this process. HER STORY:
"I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. The settlement was made on March 2, 2006."
