MY HORRENDOUS STORY:

        I am all too familiar with LAUSD's inhumane treatment of teachers that have been attacked at school.

And LAUSD's willingness to waste taxpayer money hundreds of thousands of dollars even  millions of dollars to not follow the Workers' Comp Laws of the State of California.

 

On Dec. 8, 2000 a student in my class attacked me in class. My life and health changed forever.
         
        Before the attack I worked everyday at Sepulveda Middle School in North Hills CA.  I was a fully credentialed contract teacher and I was a very happy, healthy and positive person with the energy of 100 people. I taught 5 or 6 classes a day with almost 40 students in every class.  On Dec. 8, 2000 I was attacked in my classroom by one of my students who sprayed me in my face with the toxic chemicals from a fire extinguisher. The principal, Mrs Charness, never called the paramedics even though I was gasping for air. Proper procedures were not followed by the principal. My color was ashen. It was so hard to breathe, talk, and think. I had excruciating chest pains. My tongue was swelling and my nose was closing. My face and skin were burning from the chemicals. I had a terrible headache and my sinus cavities were killing me. My muscles felt like mush. I was coughing and coughing. I was so sick and out of it. And no one was helping me or my injured students.
         
        There was no nurse at school that day. I just sat in her office hoping I was going to live through this horrendous nightmare. After 3 hours of being so sick, I was told I had to drive myself home. To this day, I have no idea how I ever made it home that day. I just kept getting sicker and sicker. I tried to come back and kept asking them to clean up the toxic chemicals all over my classroom. But, they never properly cleaned up the room. I ended up with pneumonia, lung damage, toxic fibromyalgia, "fibro fog", chest pain,  extreme fatigue, Internal problems, skin rashes and coughing, and I now have permanent black circles around my eyes. It is hard to talk, breathe, sleep, remember, concentrate, focus, walk and many other things.
         
        LAUSD awarded me an "Act of Violence," meaning a physical injury. An "Act of Violence" is very hard to get.
         
        And if you ask what happened to the student, nothing did.  Nothing!  The principal and LAUSD school police would do nothing!
         
        LAUSD's constant refusal to properly treat me or pay me has made my medical condition worse and I am now suffering from PTSD.  Even LAUSD's own doctors have admitted, through the years, that I'm getting worse-All Documented.  I do not get the proper medical treatment and medicines that I need. LAUSD doesn't care.  They now want to pay me only $38.65 a week. They are trying to squeeze me so I will give up.  There have been many times I haven't had money for food or to pay for doctors, medicine, help, my mortgage, utility bills and my other bills. I'm on the verge of losing my home.
         
        Does LAUSD have to destroy my health and life? Does LAUSD have to spend hundreds of thousands of dollars to destroy my life. All the while wasting the taxpayers money.  Do I have to lose everything because LAUSD doesn't follow the law?  LAUSD doesn't even care what the professional, highly respected doctors have said in their documented medical reports.  This attack has affected the last 11 years of my Life.
         
        The bottom line is they do not want to treat me or pay me. They are hoping I give up, die off or kill myself.  I am sure they feel that if they harass me enough, delay and keep denying everything, I'll give up.  I'm not going anywhere and I'll be here to the end.

 

My case finally went to trial after 10 years. The judge in the case, Judge Jerold Cohn, libeled me and maligned my character.  And kept libeling me in each of his many decisions. His Decisions always said  that I lied on multiple occasions even though all the documented medical records and reports agreed with what I said. All the doctors, even LAUSD's doctors said I was credible.

 

The Appeals Board said there was no substantiate evidence for Judge Cohn's Decisions. All his Decisions were vacated.

        My lawyer and doctors said Judge Cohn's Decisions were the worst decisions they have ever seen.  Since the trial started 3/10/2010-1/18/2011 the judge has constantly delayed and rescinded his decisions at least 3 times in terms of his findings, award and opinion in the decisions. All the time Judge Cohn has kept his same decision (rating). But, each time Judge Cohn has libeled me and wrote and signed the most vile, hateful things about me. Surely there is something that is illegal, unjust and disgusting going on with my Workers' Compensation trial judge. Isn't a Workers' Comp Judge supposed to be fair, honest, and just. And be able to read and comprehend English. Not Judge Jerold Cohn. I will be more than happy to open up all my records.

My case was Appealed. The Judges said there wasn't any evidence to substantiate Judge Jerold Cohn's Decisions. I Won the Appeal. All Judge Cohn's Decisions were  Vacated. There wasn't substantiated evidence for them. The Judges could have made an Award. But, they were missing a few pages they had 310 pages.  Now my case goes back to Judge Jerold Cohn.

 

How long will LAUSD keep wasting the taxpayers money? It all seems very suspicious.

I put myself through school to become a teacher. I have a Master's Degree and a Clear Teaching Credential. I wanted to share all my wonderful experiences from all over the world with my students. Also, I wanted to encourage the students that they could live their dreams.
         
        Teaching was my life and I would like my life back.  LAUSD wants me to go away.  I'm not going anywhere. I find this all so illegal and immoral. I find it so disheartening to see this kind of behavior in my own school district.
         
        I am American War Hero who was a hostage, a target and an evacuee out of Iran in 1978.  I'm the one who started the evacuation so that 40,000 Americans got out. I also told the terrorists what to do to  themselves in their constant daily "death threat" phone calls to me. I am a fighter and will not go away.

Susan Lee Schwartz Suffern, New York

Susan studied literacy education, English literature, and fine arts and holds a BA ('63) and MS ('65) from Brooklyn College, and has the equivalent of two master's degrees, earned in graduate studies of literacy, arts and education. She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. At the end of her research, her unique curriculum was selected by the LRDC to be used in their national staff development seminars for school superintendents. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. In the nineties, she rose to prominence in national educational circles, while teaching at a new magnet school, East Side Middle School. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. Her essay here on Perdaily,  is one that describes this process. She is the voice of dedicated and talented classroom teachers who know why the schools are failing.

"I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. The settlement was made on March 2, 2006."

Susan estudió la alfabetización, la literatura Inglés, y las bellas artes y tiene una licenciatura (63) y MS (65) en el Brooklyn College, y tiene el equivalente de dos grados de maestría, obtuvo en los estudios de postgrado de la alfabetización, las artes y la educación.
