David Lyell's political aspiration are his exclusive motivation. The well-being of his fellow teachers has nothing to do with anything he says or does. Before David ran for UTLA Secretary, he blogged for me at perdaily to advance his candidacy, while doing the same at NYC teachers, and anywhere else he could to promote himself, his career, and his candidacy for UTLA Secretary - his first step toward the political career he so covets - think LAUSD Board member Jose Huizar for a comparable plan. Predictably, after being pursued for access to perdaily and other sites where I blog, II haven't heard much from David since his election. I wonder why?

David has acknowledged the hundreds of teachers that are being removed from teaching- usually at the top of the salary scale and nearing retirement- on trumped up charges; charges that he and the latest group of self-aggrandizing and quisling UTLA leadership has done nothing to stop since coming into office July 1st.

As a matter of fact, LAUSD could not do what it continues to do by bring bogus morals charges under Education Code 44939 to completely by-pass collective bargaining in the removal of teachers unless UTLA and David and Company allowed this to continue completely unchallenged. While UTLA Attorney Roger Scott was irate 10 months ago at my Skelly hearing, when LAUSD in bad faith alleged that I was downloading porn on a school computer without supporting such claims with any evidence and while President Warren Fletcher told me that all teachers represented by UTLA have an insurance policy to protect them against this kind of behavior on the part of LAUSD that threatens their careers and livelihood, as of this writing UTLA has done nothing to protect me or any other teacher who has the misfortune of being "represented" by this 5th column LAUSD surrogate.

But David's motto is: "I get along with everybody." When I was put on unpaid administrative leave pending dismissal from LAUSD, UTLA did not even let me vote in the rigged run-off election that saw Warren Fletcher, David, and the latest group of UTLA posers come into power. The reason UTLA staff cited for not letting me vote in a union election where I had paid dues for 15 years was "You are not longer an active member of the union." David's first response was that was the way it should be, until I pointed out to him that I had been deprived of my profession as a teacher and my right to vote in the union by a unilateral act of LAUSD and without due process of law or the proving I had done anything by a preponderance of the evidence.

I told David that according to UTLA and David's logic, all LAUSD would have to do to get rid of UTLA altogether is just put every UTLA teacher/member on "unpaid status," thereby, according to UTLA's logic, no UTLA member would have a right to vote. David thought for a second and said, "You know, you are right." But since getting into office, Warren Fletcher, David et al have done nothing and have only shown that it is business as usual at UTLA facilitating the criminality of LAUSD in allowing it to destroy the lives of teachers and other staff who have the integrity and the stupidity to believe that their union should be defending them.

David gets along with everybody. I don't because some people are truly evil. As I go into forced retirement from LAUSD and look for something to do, I think I might just spend a little of my free time following David Lyell around making people aware of his 10 year plan of doing whatever is necessary - morals be damned - to advance his political aspirations way of doing business.

What Mr. Lyell doesn't seem to get is that he might just be the last secretary/officer of UTLA, which is making itself more and more superfluous, so that their masters at LAUSD might just finally decide next time around to dispense with the charade of a union all together. This is all the more true in a privatiize/charterized LAUSD, which is clearly John Deasy's mandate
from his old bosses at the Gates Foundation.

Alas, I guess I'm one person you wont be able to get along with David. See you in the funny papers.

Susan studied literacy education, English literature, and fine arts and holds a BA ('63) and MS ('65) from Brooklyn College, and has the equivalent of two master's degrees, earned in graduate studies of literacy, arts and education. She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. At the end of her research, her unique curriculum was selected by the LRDC to be used in their national staff development seminars for school superintendents. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. In the nineties, she rose to prominence in national educational circles, while teaching at a new magnet school, East Side Middle School. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. Her essay here on Perdaily,  is one that describes this process. "I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. The settlement was made on March 2, 2006."

How can you criticize David Lyell when he just started the position on July 1st? It sounds like you have a personal issue with him more than one based on substantial evidence or a fair objective decision.

This article makes you look really negative and angry towards a man who has done good for the plight of the teachers in the union. If anything, David Lyell should be re-elected.


Chris, With all due respect, the article I wrote for perdaily states very specific reasons why Lyell and Fletcher are dishonesty. You conveniently ignore these reasons and rather choose to give them a pass- Why?

Examples: Do I lose my right to vote in a UTLA runoff election by simply being put on unpaid administrative leave as happened in the runoff? If so, LAUSD could eliminate the union by just putting all teachers on unpaid administrative leave on bogus charges like they have done with me and hundreds of other teachers. Even Lyell admitted that this was irrational, but he continues to fail to address this tactic used against hundreds of teachers like myself who have no prior negative acts and excellent prior Stull evaluations. Are you even aware that this tactic is used nationally? Check out National Association to Prevent Teacher Abuse (NAPTA).

In addition, it was Warren Fletcher who told me while running for UTLA President that teachers facing termination had an insurance policy for their legal defense. I'm still waiting for his response on this issue. I have sent him registered letters on this and other subjects, which he continues to ignore. The only "legal defense" I got was from conflict of interest challenged Trygstad, Schwab & Trygstad's Rick Schwab, whose wife sits on the UTLA Board of Director. This prick did everything he could to hobble my defense by doing exactly the opposite of what I was asking him to do, e.g. agreed to a 10 month continuance of my case before the OAH, when I was legally entitled to a hearing with 60 days- starve me out? - while assuming I was guilty of what he surely knows to be fabricated charges. He does it with every teacher that UTLA allows him to rape professionally and financially.

Consider yourself luck that I will soon no longer be a teacher, because if you and Lisa were in my class, you would not do too well with a thesis stating Lyell and Fletcher should be given more time without saying why or citing any positive support for this argument that they have done or are likely to do anything (see 5 paragraph essay form).

Like LAUSD, UTLA leadership is clearly about their self interest in total derogation of their fiduciary duty to teachers. Just ask John Cromshow or any of the other per diem paid UTLA shills about this. In Cromshow's case, he gives UTLA leadership access to his show on KPFK called Politics and Pedagogy while freezing out voices of true reform in return for his UTLA per diem. There was a time when this was illegal and called Payola.

So Chris, try and get specific as to why one should let these likely last officers of UTLA, before it is dismantled, put the final nails in the coffin of UTLA, while we should just stand by with a big silly-ass grin on our faces while continuing to mouth edspeak platitudes that they and their bosses at LAUSD have shown they could care less about. Next stop privatization. Time to wake up yet?

Before making this article available on, Lenny first posted it to LASUBS, the major substitute forum covering LAUSD. It immediately drew a response from Lisa Karahalios, a known shill for UTLA. She is the same person whom I asked few weeks ago to make a motion in the UTLA Board of Directors to discontinue any relationship with Trystad,Schwab & Trysad, the firm which seems best skilled at taking union dues while selling out union members. She hemmed and hawed about it due to controversy but did nothing. So her response to Lenny, which I've included at end of this comment, isn't surprising. However, Lenny wrote a reply to her which he emailed to me and granted permission to post it to the forum. I did but the moderator, Dave Peters, has chosen not to allow it. No surprise here either since Peters was fired by the district last December and has hoped that the union would have him reinstated or provide a prefunctory do-nothing job for him within the union. So he's the equal of Karahalios as a lap dog. But here is the preface I wrote to Lenny's reply along with the reply itself.

Once again, I'm unfortunately compelled to break protocol and reply to LASUBS. This is solely, because my associate, Leonard Isenberg, feels similarly. But this is a worthy exception. It defies credibility that someone is trying to exempt any officer of a failed union from the criticism so richly deserved. But apparently this is what's happening here. This is the same union officer who has bullied his way onto the Substance Newsletter with a pleading for mercy from the same people who have continually ignored and discarded substitute teachers as insignificant collateral damage. This in lieu of actually defending the members of a union he supposedly represents. One can only wonder how much longer substitute teachers, or for that matter contract teachers, will continue to tolerate union complicity and collusion with LAUSD. Apparently, substitute teachers haven't yet realized that they are a majority which has been convinced by their supposed representation that they are a minority. The same representation that goes on contributing union dues to politicians in Sacramento who continually take action to the detriment of teachers. So with Mr. Isenberg's permission, here is what would have been his response to the union loyalist at all costs to the union membership, Ms. Karaholios.


I did not go after David Lyell lightly. I stated some specific facts that you conveniently ignore. What has been lacking in supposed progressive teachers is both the ability to deal with specifics/reality and to posit actions by us the majority that LAUSD/UTLA leadership cannot continue to ignore with impunity.

LAUSD presently has a $15 billion unfunded lifetime health benefits that it is addressing by removing teachers at the top of the salary scale and near to retirement. UTLA has done nothing to address this and the collusion of Trygstad, Schwab & Trygstad in this process is especially reprehensible with Colleen Schwab continuing to sit on the UTLA Board.

Warren Fletcher specifically told me that teachers being threatened with dismissal had a right to insurance to pay for an attorney to defend them- not Rick Schwab who tells you how lousy your case is from the moment you walk in the door and then proceed to try and get you to take a settlement for charges he clearly knows to be bogus, so that he can make money with his license to steal from UTLA.

When you decide to address specifics and hold these jokers responsible for selling out rank and file to LAUSD for the last 4 presidents of the union, maybe we can talk. If you don't like what I say, try refuting it with facts, otherwise its just bad writing that I would give a C- to, like most of the edspeak platitudes equally engaged in by LAUSD and UTLA fungible leadership.

When is it enough for you? How many shills have to be put on UTLA payroll before you say something? Will you ever say anything or is this just your social life? I admired you once, because I saw you actually got yourself out there to demonstrate, but now I'm beginning to wonder.

Let me just congratulate Lenny on reporting the unvarnished truth about the current UTLA secretary, David Lyell. But let me also add that there are a lot of other questions we should be asking of Mr.Lyell which I don't believe he'll ever address just as he likely won't ever address what Lenny has said here. Just how did this "substitute teacher" manage to fund a campaign which even exceeded his union backed opponent? With all the resources at his disposal, why did that opponent simply roll over in front of Lyell? Has anyone ever verified the veracity of the march that Mr.Lyell so widely publicized during the campaign in which he claimed to be a participant? A pseudo march in which the union handpicked participants spent the vast majority of their time with their behinds planted in the seats of a bus except for photo ops. That's just for starters. However, let me emphasize that Lenny couldn't have been more accurately predictive of Mr.Lyell's future plans had he channeled Edgar Cayce. But all humor aside, permit me to inform Lenny of what Mr.Lyell has been up to while Lenny was composing this piece.
The substitute arm of UTLA is the STC or the Substitute Teacher Committee. Among it's publications is the Substance Newsletter which is produced through an substitute teacher editor, Linda Everhart, funded by the union and circulated to substitute teachers who are members of the union. She supposedly has command of the content which supposedly consists of information relevant to substitutes. However, she is only allowed a very small space to comment on her own and the entire newsletter is subject to union approval and censorship. The union has been known to eviscerate it in the past prior to publication. Although Ms.Everhart is supposed to have the last say over articles which appear within the newsletter, Lyell has seen fit to use his title within the union to muscle his way into it. This wasn't uncommon under AJ Duffy either. In this case Mr.Lyell has produced a fraudulent article which covers for the faked union response to Sacremento and LAUSD with an impotent and subservient appeal to them to relent in the Reduction In Force which is costing so many teachers their careers. No real action to offend the masters with whom the union colludes. So this and everything like it are what we can expect from Mr.Lyell.
