LAUSD Superintendent John Deasy needs a whipping boy for the engrained and dangerous institutional incompetence that his and prior administrations at LAUSD have allowed to exist, because they have not done their job.

On 89.3 KPCC today Reporter Vanessa Romo documented another case of administrative incompetence at LAUSD, where teacher George Martinez was allowed to leave LAUSD without charges and go to work for Inglewood Unified, even though it was pretty clear - and later proved by videos - that he was a longstanding child molester. As similar disclosures have borne out over the last couple of weeks, there has been a complete failure of LAUSD administration at both the District and school level to do their jobs.

Deasy admits that LAUSD never filed with California Teacher Credentialing (CTC) about Martinez or the other pervert teachers his and prior administrations have dropped the ball on. So what does he propose? Blame all teachers and give LAUSD Regional Superintendents the right to summarily fire teachers without the minimal due process offered by the Office of Administrative Hearings (OAH).

Ironically, as my own case shows, it is not the OAH that is not doing its job in a timely manner, but rather LAUSD's stalling that stops truly culpable teachers from being removed. In my case both LAUSD and UTLA have colluded to stall my OAH hearing for what will be almost 3 years before its now scheduled September 10, 2012 hearing date - and who knows if that date will not be continued like LAUSD has succeeded in do several times already.

Even thought California Education Code Section 44944 says teachers facing dismissal are entitled to a hearing within 60 days, in practice this is a far cry from the years LAUSD keeps teachers in "rubber rooms" hoping to force them into resigning without a hearing in a neutral forum that would show there never was a real basis to the charges against many of the teachers.

I was removed from class on bogus charges, because I reported they were graduating students with reading abilities as low as 2nd grade. Like most of these cases against teachers, LAUSD really has no case against me or hundreds of other honesty and dedicated teachers it is doing everything it can to force out of the teaching profession. So it is LAUSD that stalls the OAH process for good teachers, while ignoring the perverts.

So why hasn't LAUSD been doing its job? There are several reasons:

1. Pervert teachers tend to support LAUSD principals and administration, so they are not targeted for harassment and removal as teachers like myself and hundreds of other dedicated teachers are whose only crime is objecting to LAUSD's longstanding incompetence.

2. LAUSD administration is so busy harassing and bringing false charges on teachers at the top of the salary scale, close to vesting in lifetime health benefits, or who question the fixing by LAUSD administration of promotions, grades, assessments, attendance, and graduation, they don't have time to find the few real perverts in LAUSD. This makes schools a fertile ground for such perversion, since teachers and administrators are terrified to speak up for fear that they too will be targeted for summary removal on trumped up charges.

3. As one of the 43% of all public school superintendents now serving in the United States, Deasy is a graduate of the Broad Academy, whose primary goal is the privatization of the $370 billion a year public education business. Now Deasy can spin the pervert teacher scandal to make it even easier to get rid of even more teachers on the way to a cheaper non-professional teaching staff of instructors with diminished pay and benefits to insure greater profits when all of public education is privatized.

4. Superintendent John Deasy really doesn't know that much about what is going on, but rather depends on the entrenched LAUSD administrative bureaucracy to tell him what to say. Case in point: Deasy talks about the 3 teachers that sit on the OAH hearing of charged teachers and the 50% acquittal rate - both of these statement are untrue. There are only 2 teachers that sit along with an administrative law judge as the trier of fact and 50% of teachers do not succeed at the OAH.

This Tuesday, Deasy required all the teachers to participate in a professional development hour that was focused on mandated reporting for suspected sexual abuse of students What was ridiculous about this is that teachers already have been given this training every year, but this did not stop the pervert teachers, because the problem was not with teachers failing to do their job, but rather administrator. A more likely reason for giving teachers this superfluous training was on advice of LAUSD legal counsel as a means of lessening LAUSD the extremely high potential liability for the gross negligence with which it has been running district schools in open dereliction of its duty to students, teachers, and parents.

A rather sad observation was made by a fellow teacher as to an inestimable cost of LAUSD administrative incompetence:.

"The sad upshot of this whole debacle is that elementary school teachers who teach the primary grade level are afraid to respond to the naturally effusive displays of affection of the little ones. We need to keep a safe distance from the little ones now, but how do you do that and not demonstrate rejection?"

She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. "I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. The settlement was made on March 2, 2006."

I went to Catholic school where the monsignor did the molesting. I was not a victim, but had a family member who was.

The abuses in the public schools that do exist pale in comparison to the cases of such in the Catholic schools that the Church allowed to continue unabated for decades and for which they continue to deny their responsibility locally and internationally.

And yet the Catholic Church has moved on now to dictate policy on reproductive rights because of the failure of our underfunded/nonexistent public health system. Their "policies" to make sure every possible child is born but then to support the most right-wing policies that mean that in order to survive you then have to sell off your kids for medical experimentation remind me exactly of Monty Python's _Meaning of Life_ skit on the Irish Catholic v. British Protestant POV, which is to say our health care system is as much of a joke as our public school system.

Plus, the policy wonks who are the architects of "school reform" are just as clueless as the guy who was the architect of Clinton's "welfare reform" policy, aka "Welfare to (Dead-End, Low-Paying, Part-time w/o benefits) Work" policy.

When I met this dude (then a young professor of business with a degree from Harvard and later a dean of the business school at Berkeley who served on Clinton's Economic Round Table), I remember we spent the evening arguing about 2 articles he'd published in The Economist - one about welfare reform, the other about school reform, even though he was clearly from an upper-middle-class family with no experience with welfare whatsoever and of course absolutely no experience in K-12 education.

I tried to tell him that he knew nothing about welfare, and likely the demographics of his students were more similar to his own and knew nothing as well in terms of their own 'investigations.'

I urged him to have his students actually interview the recipients of such services to see where the flaws lay. One major flaw is that it's simply not a liveable income.

I told him, "I grew up on welfare for some years because my father was in and out of the hospital. I can tell you what's wrong with it.

My mother came home crying one day because the social worker had asked her a required question at the time of all women who were acting heads of household on welfare, namely, "What man are you sleeping with?" as if she were a whore just because we were on public assistance. Considering also, for example, the lack of employment among Black men, the effect of these social policies was to break up families in order for them to survive.

In our case, I told the good professor/intellectual wonk/kid that the real problem was lack of available/affordable childcare (still a problem that goes unaddressed across the nation) and equal pay for women (which also remains quite problematic as evidenced by the Walmart case and many others, including most notably in academia itself (as evidenced by the multiple class actions for equal pay that began at MIT and spread across the nation).

We need to be getting more women into the STEM pipeline through the Ph.D. level, since that's where the jobs are that can sustain their families - not at King Burger ;-) but instead we're paying to educate successive generations of Chinese engineers, as the semiconductor industry booms in Shanghai and throughout China but they lack enough universities to provide trained personnel in material science at an advanced level - so in excess of 60% of the Ph.D.'s in EECS go to Chinese engineers who then return to China to build the semicon industry in R&D as well as design and manufacturing. These are seats that the regents of UC treat as a commodity instead of as a public function of education tied to sustainable economy. Instead our politicians argue whether the children of "undocumented" workers who will NOT be returning to their parents' home country should have access to an education!

Instead of educating people, we're sending them to jail at a cost exceeding $60k/person/year, including all ancillary support, food, medical care, etc.

Of course, the good professor didn't listen to me. After all he was the preordained "expert" on the matter, and what did we get 10 years later? We put women in dead-end jobs while their children went unattended and ended up shooting someone by accident or getting hurt, and we have an aggressively abusive school 'reform' movement that targets intelligent, engaged, and motivated teachers (while the "experts" continue to wrap themselves in a blanket of 'political correctness' and absolute ignorance).

Don't forget people like Dr. Drew are getting up there on national television pushing the witchhunt against teachers by looking at a handful of perverts.

Of course this guy knows nothing about the real aim of the inquisitions.

Time and time again I've seen capable and motivated teachers terminated or denied tenure (which is the same thing) because they questioned some policy issue in the course of following through on their professional duties and responsibility to the community.

Meanwhile, teachers who are even openly admitted by administration to be completely incompetent and derelict in their duties to their students and their parents are kept on in our public schools simply because they see nothing, hear nothing, say nothing, and do nothing, and all because of the political pressures within the public school bureaucracy designed along the lines of authoritarian top-down "management" if you don't honestly call it a "gang" in terms of retaliatory practices that are commonplace and which further cost taxpayers millions of dollars in legal costs and liability.

Further, administrators are at-will employees, and they can only be terminated by the superintendent or board (or their own supervisors), all of whom are beholden to public opinion, but none of whom seem to care about serving the needs of the body politic (instead wasting their tax dollars on targeting good teachers for "reform" measures or firing, if not actually setting people up on false criminal charges), embezzlement (they only change districts when this happens, never going to jail), lack of accountability to the public out of an attitude of "father knows best," and the rest just plain old marketing hoopla that passes for "school reform" but which is baseless in terms of scientific empirical studies and resulting data. They are useless in addressing the vital educational needs of our society and a sustainable economy.

In a casual conversation I got in one day with the executive administrative assistant for the superintendent of schools in D.C. and told her of all of the corruption and abuse in the public schools in California that have become nothing short of a toxic work environment, and asked her what a superintendent did to deserve a salary tantamount to serving as president of the United States. I was surprised when instead of brushing me off and diminishing my concerns, she took pause and replied, "I can't tell you how many people call from all across the country and locally with similar stories, and as for your second question - not much."

This evening I've had two reliable sources confirm that Deasy intends to open all accusation files on teachers going back three years and hand them over to the state. Also, you may remember two weeks ago when I mentioned the teacher that was sent into detainment on accusations along with all the classified sp.ed. staff in his room. That same teacher is the latest to make the news for inappropriate behavior. I have also been informed that the teacher who was accused of being the co conspirator at Miramonte was accused by two 18 year old girls from when they were in second grade. One has already recanted her story. It just keeps getting wilder and wilder. It looks like we’re in for a full blown inquisition. Deasy only seems to have one tactical approach and that’s to keep the attention off himself and the administrative hierarchy by imposing entirely on the certificated and classified staffs.
