The proposed changes to the teachers' dismissal process in light of the Miramonte and other child abuse scandals that have recently rocked LAUSD are based on patent falsities. The reality is that the present legal structure for teacher dismissal proceedings would have been more than adequate, if LAUSD administration had not been completely derelict in its duty. Sadly, reporters like KPCC's Tami Abdollah who covered this story only parrot the false statements feed to her, while exercising no independent journalistic investigation that even a cursory examination of the facts would have shown to be untrue. Regrettably, this seems to have become standard operating procedure in virtually all mainstream media.

The real reason LAUSD is seeking to streamline the teacher dismissal process has more to do with getting rid of expensive teachers at the top of the salary scale, teachers about to vest in lifetime health benefits under the Rule of 80, or simply to get rid of teachers like myself who had the temerity to question overt and longstanding administrative fraud by LAUSD administration in assessments, attendance, promotion of students, and graduation, where no honest standards have been maintained by LAUSD administration for years. Next stop: privatized public education.


The resolution states, "The Education Code needs to be updated and clarified as it currently includes outdated and irrelevant language regarding grounds for termination such as 'membership in the Communist Party,'" Whether still relevant or necessary in 2012, "membership in the Communist Party" is still grounds for denial of citizenship and, therefore, can hardly be considered "irrelevant language," if it also happens to appear as a reason for denying someone a teaching credential.

Here are the major changes to the Education Code that the resolution outlines according to Ms. Abdollah's article as well as my analysis:

  1. "Allow districts to proceed through the hearing process after board dismissal, without continuing to pay the employee. Permanent certified employees have 60 days after their notice of dismissal to demand a full administrative hearing. The process usually lasts more than one year, and the employee is usually paid throughout that time, the resolution states."

Presently, once the LAUSD Board votes to dismiss a teacher, that teacher is put on unpaid administrative leave immediately. In that status, the teacher is neither paid nor do they receive any benefits- their health benefits are immediately cancelled.

Once the LAUSD Board votes for your dismissal, you have 30 days to request a hearing before the Office of Administrative Hearings. If you fail to do so within this narrow timeframe, your dismissal is final.

California Education Code Section 44944 gives teachers so charged a right to have their hearing within 60 days, but this never takes place because of stalling by LAUSD with collusion by United Teachers Los Angeles (UTLA) and their attorneys Trygstad, Schwab & Trygstad that grant LAUSD unjustified continuance after continuance to stall the process - in my case, although I requested an immediate hearing, the first continuance was granted LAUSD by Trygstad, Schwab & Trygstad, against my specific instruction not to do so, for 10 months. My present hearing is now scheduled for 2 years and 8 months after I was initially removed from my classes on bogus charges, even though I have always sought a speedy hearing.

These dilatory tactics are employed by LAUSD with the aid of UTLA and their attorneys to starve out teachers before they have a chance of adjudication in a neutral forum as is their right under law. How many of you could survive and litigate in your defense even if the charges against you were completely false and a knowing fabrication by LAUSD leadership? 

2. Allow notices of dismissal to be given year round, and shorten or eliminate the 45- to 90-day grace periods between when an employee is notified of dismissal and when the board can initiate dismissal proceedings.

This statement is completely ambiguous, since it is only the LAUSD Board that can dismiss a teacher after the recommendation of LAUSD's Chief Academic Officer in a Skelley Hearing, where the teacher is supposed to be confronted with the evidence and given a chance to defend themselves. It is only LAUSD attorneys that seeks delays and continuances over the summer months by alleging the lack of availability of witnesses at this time. These proceedings and all other proceedings leading up to them are a complete formality without substance, since from the moment a teacher is identified for removal from LAUSD, none of the "due process" offered has any chance of vindicating the teacher.

3. Allow the introduction of evidence from cases more than four years prior to the date of filing.

In all areas of the law there is a statute of limitation for filing actions, based on the logical notion that evidence and witnesses become less reliable over time and that an individual should either be charged or vindicated within a reasonable period of time. It goes against basic notions of fairness to think that old and unreliable cases or cases in which the person charged has already been vindicated, could be subsequently used to establish an inference of guilt.

4. Change state law so as to prohibit any public employee convicted of sexual abuse of a minor from receiving their pension and retirement benefits, even if the employee resigns prior to dismissal. Any pension money that is withheld would go toward reimbursing the district for litigation costs and any surplus money would be directed to the Los Angeles Fund for Public Education or charities that support victims of sexual abuse.

As a matter of course, LAUSD has been charging teachers like myself with violation of Education Code Section 44939 morals charges. However, this has not been done by LAUSD because there is any good faith belief that I or any of the hundreds of other teachers so charged are guilty of violating this code section. Rather, LAUSD has figured out that it can leapfrog over a teachers rights to grievance and arbitration under the LAUSD/UTLA Collective Bargaining Agreement by charging a teacher under this statute.

When the LAUSD Board finally voted for my dismissal, as part of a protracted process where their only strategy seems to be to stall, I was told that I could not collect unemployment compensation, if I was hit with a morals charge under California Education Code Section 44939. While this is true, the Employment Development Department (EDD) that handles unemployment claims told me that they would not deny me my unemployment compensation unless LAUSD came up with some evidence in support of such a pernicious charge. The gentleman I talked to at EDD, who granted my unemployment claim told me that LAUSD never offers any evidence to them in support of moral charges against teachers and that the EDD would not deny unemployment benefits without LAUSD so doing.

While it might be a good idea to deny a teacher convicted of sexual abuse of a minor their pension and retirement benefits, to then turn that money over to LAUSD would be a travesty, since it has been my experience in my own case and in the numerous other cases I have monitored that LAUSD administrators use lawyers and legal process to harass good teachers, while allowing the few perverts in LAUSD to thrive by their merely going along with whatever their principal asks- no matter how outrageous.

Given school culture, where little goes on undetected, one must ask why nobody reported the incidents of child molestation. Whether Ms. Abdollah or her colleagues choose to take cognizance of it, the most plausible reason is that LAUSD operates a reign of terror against any teacher with the nerve to stand against it. To give this incompetent crony driven institution more money for lawyers to further intimidate teachers would be the height of insanity.

"I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. The settlement was made on March 2, 2006."

Wow, Rene Diedrich, you really know how its done in LAUSD. These people are no friend or admirer of teachers. To top this abuse, yes I said it, abuse of teachers, Deasy has the nerve to propose a parcel tax for the waste and misspending of this bureaucracy. As I've said many times before, the problems we have are not primarily lack of funds but inefficient and wasteful use of the funding that we have. The taxpayers have been sympathetic to the shortages in education but when will LAUSD cut the fat and waste. Maybe they will give away some more schools and completely gut pubic ed. Deasy and the majority of those idiots on the Board of Education should be removed and those educators who can should run the district. Teachers unite and if the union won't do it for us, let's decertify and unionize again. Let's truly occupy our profession.

I agree,, Paula. Teachers need to unify even if we have no union. Our union clearly holds us in very low regard but that doesn't mean w can't be stronger by standing together. I feel perdaily has become the place that brings us together.
As to the issues of abuse , teachers need to understand how this effects them. Karen Horowtz offers incredible resources and insights to help Teacher's confront this wanton Mistreatment.

Mr. Isenberg is totally correct according to the law. Two things he missed are the California State Audit, Oct. 1997, 96121, concerning this issue of teachers being falsly charged with child abuse for whistleblowing. There is a legal agreement with the State of California for this to not continue and it has for 14 years. Also, the law concerning penalties for not reporting withing 36 hours to the police of potential psychological, physical and sexual abuse. The penalty for doing this is 6 months in jail. If there is interference in an investigation the penalty, after conviction, is one year in jail.

When are bad administrators going to pay the price.

That's exactly what happened to me , George and from what I see and hear, the audit did nothing to improve he problem. It. Went ignored like most suggestions the state and Feds make to Lausd. It's time to make arrests, to dismiss the real culprits and rebuild our schools.

There are many problems with this quest for prior disciplinary memos by Deasy as well as some concerns about the integrity of teachers' files.
Deasy has requested an account of all discipline, everything from tardiness to accusations of abuse. Initially he was only asking for four years , although I. have read three is when one can pull a memo from his or her file. This has always seemed unseemly to me because principals only last 3-5 years at their posts, so when the old one goes, the new one comes in and has no idea who or what is he or she is dealing with. This brings me to my next point. These files and discipline in general seem arbitrary and without and defining points of reference. We know running a stop sign is a misdemeanor punihed by a fine and points on your DL which drive up the cost of insurance. We know that if we murder someone, even a school administrator , it is a felony and more likely than not we will be incarcerated or face execution, which takes about as long as what passes for due process in the rubber room I know.
Rather than a jury, we are basically forced to defer to principals , who are afforded complete control over our fate because if they say youre guilty, and they do, local district riff raff and the shrews from staff relation will address you with a smirk and act like this is Salem Mass some 450 years ago.
They will also protect the teachers accused of abuse, sexual misconduct and other serious transgressions. This idea that will hand over any reference to a cronies misconduct left over from another administrator is misguided. If the administrator discovers anything that stains his image, like your response to some idiotic charge, he or she will remove it. In my case they have amended my file many times over. To my relief they have not have much success drumming up statements from my colleagues
They have however sited quotes from nameless witnesses . The one that really chapped my Hyde was where the witness said she feared the reprisals of my accusers and the AP twisted it so that referred to me. I know this witness well. We once were next door neighbors and very good friends. She too had issues with this teacher , who is a notorious bully and I remember her being next to me on the day of this so called incident which was not even reported until I was in the rubber room and they needed more to justify this in justice.
I dare not ask my ex friend to clarify a small detail like this as the reason we are no longer close has a lot to do with my choice to defend students from these monsters. I had many good friends until I spoke out at school. This one has young child and outrageous mortgage and an addiction to creature comforts. No one wants to risk what I did. I cannot say that I don't blame them because I do to some extent.
But in light of this aggressive teacher cleansing I hope they realize their days are numbered anyway. That's what Deasy means to do: fire teachers at will . No one will last more than 5 years except the bad teachers who cozy up to bully administrators.
With files in a principal.s control, it's a given the cronies are protected. A woman in the rubber room came and went as she pleased, using the back door. She bragged she was connected, which had to be true because she was convicted of felony assault after she ran someone down outside a nightclub. For a full year after this conviction and in the time before, she worked at a south bay middle school. Then someone sent her to the rubber room and after a few months the director walked up and said you are fired. She cried because she never saw it coming.
But some will get away with committing felonies in the class room
While innocent teachers wait and wait . It's no fun being showcased as the bad teachers. They refer to us as criminals. We cannot address the other employees or use the kitchen. My rubber room has bullies and they scare the heck outta me.
With this said I must agree the due process is a sham. My credential was sent for revocation twice, CTC said what for? Yet my Skelly hearing was never focused on the idea that maybe I was innocent nor had the individual's presiding read the file to see if there were holes in someone's account of events. I had no clue what they were looking at. I was denied discovery
They gave me the evidence when it was done This was much different than what the district sent to CTC and any of the many amended unsat , which was not like my disciplinary memes anymore because everything was cut and pasted in all new way. It still lacked anything remotely convincing that I was deserving of this ordeal.
But staff relations has already sentbCTC notice of my change in status. And to date there is no hearing scheduled. It's a done deal . I am firefv
There is no doubt that LAUSD and Utla drags this out. Teachers have no influence . We just become their scapegoats.

Finally, I will argue that CONVICTED pedophiles who are facing prison time should surrender their pensions by half , the half the state paid. This should not go to Lausd nor should we take it's word for anything. The contributions to victims and education for sex abuse even seems tacked on to justify the unethical request and temper the greedy connotations.
The money should gintonthe convicted sex offenders victims. He will need his health care and his income, without it he will rely on taxpayers to pay it. So sorry, Mr. Deasy , but if you get your way tax payers will paynfornTFA teacher temps'school school loans because instead of a decent wage you will offer forgiveness. Now you want us to support the pedophiles too? No dice it sounds okay until,one gives it any thought. Here these richer than God elitist are commandeering our schools for profit. They will essentially displace thousands of educators, and they've already made schools worse than ever. They are cutting all these things that count and very little from their own ranks which expanded over 20% in less than 10 years and have openings all over the the site,
They want profits and have hidden budget negotiations from the public.
We have no idea what they'll cut next . Art, music, preschools and adultschool, 11000 teachers!! They will enjoy public sector perks and take in crazy profits for ruining our schools,
