Yesterday at the new and as of yet unopened Los Angeles Unified School District (LAUSD) Augustus Hawkins High School on 60th Street, the teachers of Miramonte Elementary School, who have spent the last 3 months incarcerated there without even minimal due process of law, final spoke out against how they were being treated by LAUSD, which, in derogation of their civil rights, has presumed them guilty instead of innocence and has flagrantly trampled over their civil right.

In the fear laden environment that permeated the well-orchestrated gathering, some of these teachers anonymously read eloquent statements about the unjust manner in which they have been treated, while clearly indicating the continuing damage that they have been allowed to sustain from LAUSD and their union United Teachers Los Angeles (UTLA), some of whose officers did not miss this photo opportunity to show physical solidarity with teachers, even though they have turned a blind eye to them over the last 3 months.

There is no question that LAUSD is well within its rights to fully investigate the situation that was allowed to occur at Miramonte for years. However, what is most reprehensible is that this magical slight of hand engaged in by Superintendent Deasy has kept these teachers incarcerated in this empty school for 3 months and seems clearly designed to deflect public opinion off of the administrators - who were actually responsible - to these and other teachers throughout the District in this longstanding top-down bureaucracy that itself had the duty and power to stop such outrages from occurring in the first place.

Given the anonymous manner in which the statements were written and presented by the teachers, it was clear that Deasy has succeeded in terrorizing these teachers, who it is clear at this point, were and are not guilty of anything. These teachers were so terrorized today, that although they were reading their statements in public, they were too scared to allow me to publish them in written form on this site, even though the mainstream media was there in force to televise it back to their station and even though we at perdaily will post the video on this site in both Spanish and English.

Part of the fear came from the misinformation that UTLA and its officers present allowed the Miramonte teachers to operate under in telling them that they should not speak up or it would jeopardize their grievance- grievances in UTLA that rarely go anywhere except into oblivion. While it used to be that talking about a grievance was considered grounds in itself to have a teacher dismissed, this rule was modified 2 years ago, because it functioned as a non-judicial gag order to the detriment of teachers - to only jeopardized the grievance, but only if it was not for one of the now accepted purposes, like getting others to testify as to what they knew about the alleged bad acts that occurred at Miramonte and which these teachers were being smeared with without being allowed to defend themselves. Charge teachers with things they are not guilty of and them threaten them if they try and speak up to defend themselves.

Where was UTLA? Ex-UTLA President John Perez and Secretary David Lyell came for the photo-op, but in the last 3 months, all that Perez could say that UTLA had done was bring the teachers lunch one time and state that they were planning to bring them lunch next week - it didn't seem that the teachers present had much of an appetite.

Although Article V of the LAUSD/UTLA Collective Bargaining Agreement, LAUSD's own bulletin procedures, the California Education Code, and federal law have clearly been violated by LAUSD administrators running roughshod over these teachers rights, UTLA administration has remained silent to the plight of these dues-paying rank-and-file teachers, who are only the latest example of UTLA members who their union refuses to support in their most urgent time of need. So why is it teachers pay UTLA dues in this closed union shop?

So let me predict what is now going to happen to the 85 teachers who have been besmirched by LAUSD's behavior and UTLA's failure to act in a timely manner on their behalf: Superintendent John Deasy will mull things over and clear all these teachers of all charges. However LAUSD will decide to only put 45 of these teachers back in Miramonte. Why not all 85? Because Miramonte is no longer a year-around school. So now, at least 40 of these teachers are going to have to go out and look for a job in LAUSD with the stigma of being Miramonte teachers remaining as a specter to haunt them for the rest of their careers. And Superintendent Deasy, LAUSD, and do-nothing UTLA will go on to assault the next bunch of teachers, because UTLA only knows how to react and is incapable of taking a proactive position to finally make LAUSD pay a price for the unabated attack on its teachers that LAUSD continues to profit from.

Susan studied literacy education, English literature, and fine arts and holds a BA ('63) and MS ('65) from Brooklyn College, and has the equivalent of two master's degrees, earned in graduate studies of literacy, arts and education. She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. At the end of her research, her unique curriculum was selected by the LRDC to be used in their national staff development seminars for school superintendents. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. In the nineties, she rose to prominence in national educational circles, while teaching at a new magnet school, East Side Middle School. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. "I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. These long partners in crime of violating the Stull law have just made seemingly solemn promises to uphold the law but may really be preparing a joint proposal that may be circumventing the same law.
Parent, students, and teachers must remain vigilant on how the paper monster LAUSD and its puppet partner UTLA will again go around the law on teachers’ evaluation.
By the way the new ruling of the Court on teacher evaluations correlated with students’ test scores will definitely evolve toward standardized curricula, teaching and learning techniques for all teachers and students. And furthermore, the emphasis on test scores will also lead to the proper placement and specialization of students in their pursuit of education and careers and that will properly fit them in our free enterprise society.

A week ago, Deasy ordered the administrators to dig up teachers for any misconducts unreported to the California commission on Teacher Credentialing; and amazingly the administrators reported to Deasy more than 500 ( Five Hundred) unreported misconducts of teachers—of course based on false statements of facts (false or exaggerated opinions in ordinary language).
Hey, hey, Deasy the LAUSD has informed me in a registered letter about 2 weeks ago (April 31, 2012) that it was forwarding the information that I resigned or separated from your dismayingly failing school district on May 3, 2009.
He, he, he, and he, he more, you really amused me Deasy, because until now you have never forwarded to the Commission on Teacher Credentialing those more than 100 misconducts of false accusations and false charges of LAUSD against me. Ask Holmquist why not.
Come on Deasy, go ahead, and submit the LAUSD allegations, accusations, and charges of misconducts against me to the Commission. They are waiting for them, so they can calendar my hearing with Holmquist and his bunch of lawyers.
By the way Deasy, the teachers are really so scared now of the Paper Monster. It is hunting them even in their sleep, dreams, and night mares.
But me, I welcome the hearing of those misconducts against me and somewhat grateful to you and I will make sure that I will be very careful never to be to be carless again to eat or drink that food or soda adulterated with LSD.

I reiterate Deasy, be gentleman, be truthful to your directive, please forward to the Commission those alleged misconducts against me. Please hurry up Deasy I really want to meet your best lawyers in your dismayingly failing and incompetent school district, particularly David Holmquist, and that very pretty and young private lawyer of the best private law firm in Los Angeles which Cortines hired to scare me while someone added street drug into my food and soda, and of course and not the least that bunch of lawyers in your School district.

From Roque Burio Jr., here is a song for LAUSD on continually making false accusations and false charges and fraudulent publicity against several hundreds of innocent teachers. In spite of the innumerable allegations of this dismayingly failing school district against its teachers, it has never criminally charged nor found guilty anyone of these poor teachers who suffer from trial of publicity and are condemned guilty without the benefit of independent court trial or even of the administrative Court.
No teachers --not even one -- in the history of LAUSD has been found guilty in any Court in relations to any complaints made by this failing school district-- although it has spent several millions of dollars in falsely persecuting its teachers., It is all about money and greed.
The secret joint project of LAUSD and UTLA against us teachers was calculated to cover up the financial and academic failures of this school district and to use us teachers as escape goats of its failures.
The LAUSD has always made it appear in the public that many of the teachers are bad to obtain additional funding without explaining how it has been spending its past funding, and to pass the additional taxes to the people without explaining its failure to deliver the proper education to the students. Its other goal in this secret project is to obtain an educational reform that are more anti-teachers so as to gag them from criticizing how this district spent its budget and how it fails to administer and manage its schools for the success of its students. In shorter words, this dismayingly failing school district is trying to inculcate fears among the teachers and like a tyrant dictator it is nothing but a paper monster. Long live democracy, long live teachers, long live students and parents, and down with that paper monsters.

Lenny, great analysis of the Miramonte crisis and your critique of UTLA and its failure to return the Miramonte teachers back to Miramonte Elementary School. George Buzzetti, thanks for your video production of the press conference. UTLA leadership claims that 45 teachers will return,I do not believe this will happen, since many of the original Miramonte teachers are being rifd or will be going to the new elementary school. Even if UTLA prevails on the grievance, it will be too late to bring them back, since the original Miramonte teachers will be reassigned. UTLA will only get declaratory relief if it wins, which means the District was wrong in what they did. As a result, Miramonte Elementary will continue to have a perpetual stream of new teachers that do not know the students or the community. Thus, the students and the community will be the losers. The Miramonte crisis was the result of Supt. Deasy transferring the Miramonte teachers and UTLA letting it happen in the onset.

If there’s one thing I learned from attending this event, it’s that attending it was total waste of time and video. These Miramonte teachers and parents were snoockered into standing side by side with the same union devils that delivered them and their children to their enemies rather than offering any succourrance or rescue. These deceivers, collectively known as UTLA provided no support or promotion for what took place. Rather UTLA remained aloof and uncommitted and refused to respond to inquiries up to fifteen minutes before parents and teachers made their presences known. Only then did the union send in their B team of con men and con women to try to steal the show with union hacks like failed former president John Perez, do nothing secretary David Lyell who did nothing but start his campaign for the presidency early, both of whom were accompanied by union towel boys and hand maidens like Ingrid Villeda. If anything, shame on perdaily.com for even giving them the video time. If anything else, the traitorous behavior of UTLA equals if it doesn’t trump that of the vindictiveness of the district. In spite of what appears in print here which would suggest the contrary, I don’t see anything that was accomplished other than helping the dish run away with the spoon. This was one bad afternoon for students, parents and teachers. And, oh yes, especially for Per Daily.
