UTLA "LITIGATES" TO LAUSD'S STANDARDS- A FORMULA FOR DISASTER

Criminals have more rights than dismissed teachers. If you think this is hyperbole, take a moment and go through what teachers are subjected to that no self-respecting criminal would have to endure.

First of all, while the burden of proof is different in civil and criminal actions- in criminal, it's beyond a reasonable doubt and in civil, it's by a preponderance of the evidence- in both of these actions this burden is on either the governmental entity or the civil plaintiff bringing the respective actions to prove their case by the applicable legal standard. At the Los Angeles Unified School District (LAUSD), from the moment a teacher is charged, they are presumed guilt with nothing in place to protect their presumed innocence as they are put in "rubber rooms" or on unpaid administrative leave for years to try and drive them crazy or  starve them into submission .

The legal right those other than teachers have to remain silent, since they are presumed innocent, does not seem to be a legal right applied to teachers by LAUSD or the judicial system. At LAUSD, you are told to defend yourself...but you are not told what it is that you have done. Elsewhere, a preliminary legal hearing is based on serious charges, not things like "he raised his voice" or "he scowled at the assistant principal" or "she walked by the other teacher in a threatening manner." Do any of these actions rise to the level of a firing offense? My favorite is actually the 3rd grade teacher whose principal is moving for his dismissal, because he let a student go to the nurse without a note. Yes, Franz Kafka is alive and well at LAUSD.

Furthermore, in either a normal civil or criminal action those bringing charges or seeking any form of legal action must state a claim upon which relief can be granted, which requires evidence. Evidence is the verified/sworn statement of those making it that what they say is true. The reason it is made under penalty of perjury, which is a felony if false, is to dissuade people from being intimidated by their principal into bearing false witness against another teacher for fear of not bringing the wrath of the principal on themselves for failure to comply. At LAUSD, the imagination is the only limit to the charges they cook up to get rid of teachers, since perjury is not an impediment, because none of the charges they bring against any targeted teacher are verified, under oath, and under penalty of perjury.

Any attorney fresh out of law school could tell you that, but you don't have an attorney. Rather you have an out of classroom or retired teacher now working for United Teachers Los Angeles (UTLA), who goes through the motions without having the slightest idea how to protect you or your civil rights. This is worse than having no representation at all, because it lulls the unsuspecting targeted teacher into thinking that the union they have paid dues to for all those years must be doing what needs to be done or giving you the advise necessary to protect you and your career as a teacher- nothing could be further from the truth. Only most teachers don't find out until it is too late.

All this is bad enough, but what drives most teachers nuts is their failure to understand that LAUSD and their partners at UTLA don't have to have any real charges to get rid of you. All they have to do is starve you out, since from the time you are put on unpaid administrative leave, most teachers start to hemorrhage savings trying to keep their head above water long enough to vindicate their rights.

What is even more pernicious is that LAUSD and UTLA know you are innocent, but what they also know is all they have to do is wait you out, since few teachers have the awareness and money necessary to enter into a protracted legal battle that takes years.

There is a way that teachers can stop what has seen the forced removal of 300,000 teachers around the United States over the last few years and that is by getting together and bringing unified legal actions against both LAUSD and UTLA, since that is the only way the teacher witch hunt will end. Susan Lee Schwartz Suffern, New York

Susan studied literacy education, English literature, and fine arts and holds a BA ('63) and MS ('65) from Brooklyn College, and has the equivalent of two master's degrees, earned in graduate studies of literacy, arts and education. She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. At the end of her research, her unique curriculum was selected by the LRDC to be used in their national staff development seminars for school superintendents. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. In the nineties, she rose to prominence in national educational circles, while teaching at a new magnet school, East Side Middle School. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. Her essay here on Perdaily,  is one that describes this process. "I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. Los delincuentes tienen más derechos que los profesores despedidos. Si usted piensa que esto es una exageración, tome un momento y pasar por lo que los profesores están sujetos a que no se respete a sí mismo criminal tendría que soportar.

Por otra parte, una audiencia legal preliminar se basa en acusaciones graves, no cosas como "alzó la voz" o "él frunció el ceño ante el director asistente" o "ella caminaba por el otro maestro de manera amenazante". ¿Alguna de estas acciones llegan al nivel de un delito de fuego? Mi favorito es en realidad el maestro de 3er grado, cuya principal está moviendo por su despido, por haberse dejado a un estudiante ir a la enfermería sin una nota. Sí, Franz Kafka está vivo y bien en el LAUSD.

Por otra parte, ya sea en una acción normal de los civiles o penales presentación de cargos o la búsqueda de cualquier tipo de acción legal debe establecer un derecho al que se puede conceder alivio, que requiere pruebas. La evidencia es la declaración verificada / jurada de aquellos por lo que es que lo que dicen es verdad. La razón por la que se hace bajo pena de perjurio, que es un delito grave si es falso, es disuadir a la gente de ser intimidados por su director en falso testimonio contra otro profesor por temor a no llevar la ira del principal de ellos mismos en caso de incumplimiento . Todo esto es bastante malo, pero lo que impulsa a la mayoría de los frutos secos maestros es su incapacidad para comprender que el LAUSD y UTLA a sus parejas no tienen que tener ningún cargo reales para deshacerse de ti. Todo lo que tienes que hacer es matar de hambre a salir, ya que desde el momento en que son puestos en licencia administrativa remunerada, la mayoría de los profesores comienzan a ahorros hemorragia tratando de mantener la cabeza fuera del agua el tiempo suficiente para reivindicar sus derechos.

Lo que es aún más pernicioso es que el LAUSD y UTLA sabe que es inocente, pero lo que también sabemos es todo lo que tienen que hacer es esperar a salir, ya que pocos profesores tienen la conciencia y el dinero necesario para entrar en una prolongada batalla legal que lleva años .

Hay una forma de que los maestros pueden detener lo que ha visto el traslado forzoso de 300.000 profesores de todo Estados Unidos en los últimos años y que es imprescindible adquirir juntos y llevar acciones legales contra unificadas tanto LAUSD y UTLA, ya que es la única manera que el maestro caza de brujas va a terminar. Susan Lee Schwartz Suffern, Nueva York

Teachers who are innocent tend to believe in truth and justice. Few have read the contract much less education codes or state laws like 820 which protects administrators from rosecution and civil liability even when they act in malice, which sadly, they often seem to do. Likeany decent human, innocent teachers are reluctant to sue the school district, which is in essence suing tax payers ( which they are) and penalizing students for administrators' ethical deficiencies. Of course most teachers assume they have paid their dues and the union will come through. After all, t is impossible to fire teachers thanks to the unions, right?
Most innocent teachers are willing to let it all go if they are just returned to class and offered an earnest apology. Most innocent teachers believe they are an anomoly, that logic will prevail and if it doesn't they will somebody's proverbial ass off.
My rep was grim, he told me I had to have donesomething wrongI would not be in this mess. I reminded him that the UTLAchairs and I had prevailed upon him for assistance since this principal arrived, that he was waist deep in grivances and had several agencies incpvestigating him for discrimination against women.
He told me to keep my mouth shut. In the meeting, I felt like I was in a cult tribunal. The suits mouthed the same phrases and shared a smug smirk until I spoke up. Each time I did so the rep dug his nils into the flesh of my arm, but I persisted because I saw the expressions of the director and staff relations harpy change. They looked at the file before them, saw what I said was true and looked , dare I say, worried.
I had marks like half moons in my flesh. The director wa equivocating. Why was the rep so upset by this? I was not sure, but I knew he was not on my side. I believed my fellow inmates were guilty until I was in the rubber room for an hour. Some were. Most were not. They were meloncholy but happy to have someone new, my rage galvanized a couple. The funny thing is, most were candid... they knew they were crazy too. They told me how they ended up in this mess. The suits disliked the way I brought the innates together and sent put me under house arrest the second day. I assumd they realized they made an error and were figuring out what to do. I decided to use the time off to do things I had no time orenergy for when I was working. I worked on an anthology, fixed up my house a little, took weekend trips to local spots. I missed my students who had rebelled at my unfair exile. They kept up with me on facebook.
Then one day I googled " teacher jail" "LAUSD" and "corruption" i had read the Lemon Dance and LAT expose, which had me siding with poor little Mr. C. But when I read them again it was like I was somene else. Then I found Perdaily. I called Lenny. What he told me confirmed my worst fears. He, Mark Hemphill and I have learned a great deal since then.
Like teachers do not give a damn about any of this until it happens to them. I was eventually sent to the rubber room after my rep, the staff relations harpy and my mobbers turned my grivance arbitration into a side show while an addled old man objectedagain and again yet never insisted we discuss the matter at hand: repeated breaches in CBA protocol as well as education codes. When the ruling arrived I was horrified. I had never read any legal papers wtitten this way.
The judge said I was deranged. He justified the assertion by stating that m facial expressions during the hearing were evidence of my guilt.
The funny thing is the old guy coud not see my face nor I his until I was allowed to speak at the end of a our hour ordeal where an APsited my legal gun permit some 30 years ago as a reason to believe I was guilty. These witnesses contradicted each other, they disparaged me with lies that were had nothing to do with the charges. I was called a racist when I am myself part African American . The judge seemed to note tese thing more agressively than the rep. He even winked at me at the end as I put on my coat.
When I showed the judgement to lawyers I know, they agreed the writing was conspicuously unprofessional and incriminating. They also explained that it would still hurt me in court. This makes one angry, and anger is crazy unless it is used as an energy that galvanizes action. Easier said than done. One suddenly understands how the unabomber is born.
But there are better ways. Logic, my natural inclination is, of course, the best option. It will be thwarted. One must anticipate this and learn from the errors of those before them.
I was not inclined to go to teacher jail or as I now call it " the rubber room." this phrase was coined in NYC, where perdaily has found mny friends and a great deal of its direction. Betsy C, who became an unlikely champion for wronged teachers and a single voice of reason says, " the rubber room is not a place. It is a process."
I have always suspected that human beings are all insane. I have heard those who question thier sanity are probably the sanest. Question everything, including yourself. You will not find reason or logic, but it will find you and when it does, you will have some peace. This is what we need to prevail. It is a paradox, perhaps an oxymoron, but when one knows one is rightous, it makes all the difference. We may not win but we will prevail.
