From LAUSD's point of view, what is the downside they face from screwing teachers? It is now close to 3 weeks since Scott Mandel wrote in a letter reproduced below that "UTLA President Warren Fletcher was actively working on your plight." So, other then staff-development-like rhetoric, what has been accomplished to address the exigencies of this longstanding and yet UTLA ignored teacher jail reality that has been openly destroying innocent teachers' lives for years? And UTLA officers and staff didn't know about this? UTLA not only knew, they consistently told innocent teachers, "You should resign, you've got a bad case." UTLA has given credibility to this LAUSD witch hunt by taking part in it, while never actually doing anything to defend teachers or hold LAUSD accountable. If you were LAUSD, would you stop the witch hunt under these circumstances? Why would you, when you got rid of 853 teachers last year without not even one getting their job back? They're batting a thousand.

What about the teachers who have already lost their jobs and are in the process of having their credentials lifted by California Teacher Credentialing with literally no verified evidence under penalty of perjury against them as is required by statute. So that they will not only lose their jobs with LAUSD, but will also never again be allowed to work anywhere as a teacher?

Where has Warren and UTLA been up until now? He doesn't know when a teacher is removed? Bullshit! UTLA has refused to aggregate all these hundreds of claims into one unified action under Article V of the Collective Bargaining Agreement with LAUSD or move on clear due process and civil rights violations and proceed in federal court as I am doing for the complete and utter denial of basic due process of law. Whatever happened to innocent until proven guilty by a preponderance of the evidence with the burden on LAUSD to do so? Did UTLA officers, staff, and legal counsel sleep through their high school government course that clearly explained these inalienable rights? Why is teacher guilt and the obscene dilatory tactics of LAUSD...and UTLA... which are designed to starve teachers into resignation tolerated by UTLA? What is a real union supposed to do when these tactics are employed by management? Check out what Chicago Teachers Union did in the same circumstances.

Saying "Things are beginning to change" doesn't make it so...Fletcher had a meeting last week with ALL of the UTLA lawyers," So, it is now 3 weeks later, what have they done? ABSOLUTELY NOTHING. When there are a multiplicity of actions with common facts, and where monetary damages are not adequate and irreparable harm are involved, the law offers Injunctive relief. The only problem for LAUSD complicity UTLA in this witch hunt is that you have to ask a court for such relief. If you go into a case with LAUSD as was most recently seen in the Tentative Agreement case between LAUSD and UTLA on teacher assessment and never tell the judge that students are many years behind grade level, how do you expect a fair teacher assessment regiment for single-subject credentialed teachers that have no reasonable basis to engage the average student they face, who is hopelessly years behind and without the prior grade-level standards they need to understand what the teacher is talking about.

It is now close to a month since UTLA finally took cognizance of teacher jails- what have they done? NOTHING. Since Miramonte, the number of teachers targeted has been put into overdrive by LAUSD with absolutely no legal action taken by UTLA. Let me know what you think of the following by Scott Mandel. To My Brothers and Sisters in Teacher Jail:

As your voice on the UTLA Board, I want to bring you up to date on what is going on:

Things are getting better!  We received a report, per my earlier motion, at the UTLA Board meeting this week.  The following is a detailed summation of the highlights:

Warren Fletcher is now actively working hard on your plight, and things are beginning to change.

First, Warren had a meeting last week with ALL of the UTLA lawyers to go over strategy--legalities and such for all aspects of the motion I wrote on your behalf, along with other related issues.  They are now calling it the Housed Teachers/Dismissal issue, and are going at it full force.

We also have a new Communications Director who is awesome and making your issue in the forefront now.  The Daily News article--which was even-handed for once, was a start.  Subsequent reports are BEGINNING  to sway public opinion in our direction for the first time.  This is a SIGNIFICANT turn of events for us.

President Fletcher also put a video on this issue on the UTLA web site (utla.net look at "Current Videos").

In addition, Warren has asked the staff at UTLA to put together Tool Kit for every housed teacher to receive when they arrive at Teacher Jail.

Most important, we are looking into possible PERB charges against the District on your behalf.  We are requesting information concerning the numbers of teachers reassigned from their classrooms (something the District has not given us), along with demographic information as to "who" the teachers are that are being removed.  We have concerns that the district is targeting teachers over 40.

Now, the most important part, and what we need from you.  We are bypassing the madman Deasy and going straight to the School Board.  We are working with them as much as possible to understand the abuses of power perpetrated by the Superintendent.  We need the following from each of you:

Contact your school board member.  Let them know how you have been subjected to lengthy ridiculous delays in due process, including district ignoring of vindicating evidence when appropriate.  Also let them know, in human terms, what this experience has done to you and your family.  Do NOT NOT NOT go into pleading your innocence or facts of your case.  Focus on the process, and the human cost it is taking on you.

Stay strong, stay confident.  The process is long, and we are dealing with a ridiculous situation.   I now believe that Alice in Wonderland is a documentary--verdict first, trial later is now standard procedure.  

Know that UTLA IS working for you, and that we believe that the tide is beginning to shift in our favor.  It will be a long struggle still--and it is CRITICAL that all of you help us in retaking the School Board in March.  But eventually we WILL win on this, and the injustices you have suffered so far will be rectified.  

Stay strong.  Stay united.  We will win this in the end.

Innocent until proven guilty! why are unions allowing their teachers removal since there not evidences? Why are district spending on salaries if they have the evidences? it is not because of union protection, is due to lack of compliance by your district for not reporting the cases of teachers dismissed. Why innocent teachers are quite, if you are Innocent, tell your story. Do not let your file grow, if they follow the process even if it is full of lies, its hard to win, but the more time passes people/witnesses forget, or retire. Innocent until proven guilty.

Both LAUSD and UTLA know that the vast majority of teachers targeted for removal are completely innocent- those who aren't are already in jail. LAUSD started this witch hunt against teachers after the Office of Risk Management and Insurance Policy came out with a report by then Director David Holmquist in 2006 that teachers at the top of the salary scale and/or about to vest in lifetime health benefits were pushing the District into the red. They also noticed the predictable reality that 49% of medical benefits were being used by 6% older teacher, which is the way all medical insurance is supposed to function

Now Holmquist as Chief Legal Counsel for LAUSD is implementing this purge of teachers to fix LAUSD's bottom line. Their main tactics are to drive the teacher nuts by harassment and rubber rooms, only to be followed by a protracted lack of timely legal process based on the notion that LAUSD with its $500 million "legal defense fund" can bleed longer than the teacher. As of this writing, LAUSD and their groupies at UTLA cannot believe just how many teachers they have been able to force into retirement or dismissal for so little money. From their point of view, why should they stop targeting teachers?

I just read that Jose Govea makes $115,000. The union bloodsuckers are only interested in one thing - having lots and lots of members so they can enjoy their lavish salaries, and perks on the backs of their members. Hate to say it, but in UTLA's case, I wish this were a 'right to work' state.

The answer to a corrupt UTLA is not a right to work state. Rather it is an honest union that defends its rank and file and doesn't collude with LAUSD. If teachers refuse to stand up and seek the reconstitution of their union by the state and federal government, they have nobody to blame but themselves.

Are you serious? I agree the union's response is late and inadequate. Many teachers are already detached and doubtful about what the union does for them. The union needs a complete overhaul, reconstitution if you prefer. The relationship between its chapter chairs and the leadership is broken to the point that neither one knows what the other is doing. When issues arise, lack of information and direction dooms the chapter chair to an ineffective response. The strength of the union is in its membership and the union neglects them as evidenced in the 800plus colleagues that were lost to this witch hunt. We need to seize control of LAUSd by first, electing a school board that believes in public education, firing Deasy and his boys and overhauling the union to be more responsive to its membership and the community at large.
