LAUSD GIVES ME A CHANCE TO BE A HERO FOR STUDENTS, TEACHERS, AND FAMILIES - CARE TO HELP?

The Los Angeles Unified School District (LAUSD) offered me close to a quarter of a million dollars and vesting in my lifetime health benefits, if I would agree to settle and not go to the Office of Administrative Hearings (OAH) to vindicate myself against charges fabricated against me. I reported that my school, Central High School Continuation, was graduating students and giving diplomas to students with low elementary school English language and math skills. After stalling the process for 3 years, most financially strapped teachers would have jumped at this offer, but I could not.

What I could not rationalize away was that I was being given the option to just walk away pretty much financially intact, if I would just forget about the fact that 59 years after Brown vs. Board of Education, LAUSD remains segregated (closed to 90% Latino and Black) and toxic to students and teachers. But more importantly, I see a real armageddon for our society in the not too distant future, if something is not done to finally address the travesty that LAUSD and districts like it around the United States represent to predominantly poor and minority students of color. Nobody is offering these students any money after screwing them out of their right to an education and the ability to reach their potential and dreams, so how could I be comfortable taking LAUSD blood money to just go away.

I am not a wealthy man and have already paid a very heavy financial and emotional price, but it occurred to me that I was far luckier than the literally hundreds of other teachers who over the last several years call on a daily basis to tell me their own LAUSD nightmare story of being targeted after a prior unblemished career in teaching like my own. It is always preceded by the same phrase, "I can't believe." Many of these teachers have lost everything. 

Over the last few years, I have reinvented myself into a financially downsized lifestyle that I can get by with without selling out the values of my youth that got me into teaching in the first place. It occurred to me that I am not living under a tarpaulin in Haiti and as such I have an affirmative obligation to stand up to the blatant racist and corrupt LAUSD, where no good act goes unpunished, if I want all of our children to live in anything that even remotely resembles an honest democratic society with liberty and justice for all as something more than just hollow words. 

This last week I was notified that the OAH decided in favor of LAUSD in my 3 year stalled case, which is something I have anticipated, given the political power of LAUSD and its $7 billion budget replete with political connections. To quote John Lennon, "Money screams." It now remains for me to appeal this decision for myself and the hundreds of other teachers who are already on the LAUSD oblivion legal express and those who will soon follow in the now ahead of schedule privatization of LAUSD and public education for profit; along with the dumbing down of the electorate to a point where they do not have enough education to understanding what's going on to stand against it. 

Given my already substantial financial contribution in addition to the renounced settlement, I would hope that you would strongly consider investing in my case, so that we can afford the expensive legal processes that loom ahead in both state and federal courts. There are now some attorneys willing to take on these cases and defer much of their billable hours, but the out of pockets to vigorously advocate on behalf of teachers who have been targeted is going to cost.

If we are able to win, it will establish legal precedent to defend other teachers already targeted for termination or those who soon will be. It might also reopen some of the hundreds of cases against teachers that LAUSD has already won, because nobody has had the money and commitment to effectively fight back. If LAUSD and individuals within it are finally held accountable for their illegal behavior, who knows, it might just stop or at the very least become significantly diminished.

Another thing you might consider is voting for me as a write-in for President of United Teachers Los Angeles in the next elections in February 2014. It is worth mentioning the following facts:

1. UTLA has not only done nothing to stop the witchhunt against teachers, it has actually facilitated it by going along and saying nothing as LAUSD violates the Collective Bargaining Agreement, its own Bulletins, and both state and federal law in its war on teachers. Or to quote UTLA's Roger Scott at my ersatz Skelly hearing, "There's no due process here." True Roger, but did you do anything about it? 

2. Present UTLA President Fletcher and the other out of classroom officers of the union were elected in the last election by only 17% of rank and file due to complete teacher apathy over the long established fact that UTLA does absolutely nothing to address by proactive actions to confront LAUSD corrupt war on teachers with a clearly enunciated UTLA plan of action in the face of LAUSD actions designed to ultimately destroy or completely emasculate the union. We have gone from over 42,000 teacher union members and fee payers to less than 30,000 and dropping. Nonetheless, Fletcher says that UTLA doesn't act, because we don't have dues?

3. Alex Caputo-Pearl represents just another faction of business- or lack of same- as usual at UTLA. He stood by and watched the reconstitution of Crenshaw High School by LAUSD and did nothing. There is nothing that either longstanding UTLA faction has done to stop the LAUSD juggernaut from decimating the ranks of teachers at the top of the salary scale; about to vest in lifetime health benefits; disabled; or just actually trying to educate all students.

4. A protest write-in vote for me stands a better chance of protecting teachers in a manner that a union is supposed to because I will work with colleagues to clearly define what UTLA stands for and is willing to fight for, instead of waiting to react to LAUSD's latest outrage, which is always a losing strategy. No successful professional union allows its employer to define what it stands for. A proactive union leadership with a clearly enunciated and implemented platform will end the apathy that is killing UTLA and its members.

El Distrito Escolar Unificado de Los Ángeles (LAUSD ) me ofreció cerca de un cuarto de millón de dólares y la adquisición de derechos en mis beneficios de salud de por vida , si estoy de acuerdo para resolver y no ir a la Oficina de Audiencias Administrativas ( OAH) para reivindicar a mí mismo contra los cargos que fabricado en mi contra. Tras el estancamiento del proceso de 3 años, la mayoría de los profesores atados financieramente habrían saltado en esta oferta, pero no pudieron.

Lo que no podía racionalizar era que me estaba dando la opción de alejarte bastante financieramente intacta , si me acaba de olvidar el hecho de que 59 años después de Brown contra la Junta de Educación , el LAUSD se mantiene segregada (cerrado al 90 % Latino y Negro ) y tóxicos para los estudiantes y profesores. Pero lo más importante , veo un verdadero Armagedón para nuestra sociedad en un futuro no muy lejano , si no se hace algo para finalmente abordar la farsa que LAUSD y otros distritos como el que alrededor de los Estados Unidos representan a los estudiantes predominantemente pobres y de las minorías de color. Nadie está ofreciendo a estos estudiantes el dinero después de atornillar a salir de su derecho a la educación y la capacidad de alcanzar su potencial y sus sueños , así que ¿cómo podría yo estar cómodo tomando LAUSD dinero de sangre simplemente a desaparecer .

Yo no soy un hombre rico y ya he pagado un precio muy económico y emocional muy fuerte , pero se me ocurrió que yo era mucho más afortunado que los literalmente cientos de otros profesores que en los últimos años llaman a diario a decirme su propia historia pesadilla LAUSD de ser blanco después de una carrera intachable previa en la enseñanza como el mío . Siempre es precedida por la misma frase : "Yo no puedo creer . " Muchos de estos maestros han perdido todo.

En los últimos años , he reinventado a mí mismo en un estilo de vida reducido financiera que pueda llegar a funcionar con y sin venta de los valores de mi juventud que me metieron en la enseñanza en el primer lugar . Se me ocurrió que yo no estoy viviendo bajo una lona en Haití y , como tal, tengo una obligación positiva para enfrentarse a los racistas y corruptos LAUSD flagrante , donde hay buena acción queda sin castigo , si quiero que todos nuestros niños a vivir en nada que se asemeje ni remotamente una sociedad democrática, honesta con libertad y justicia para todos como algo más que palabras huecas .

Esta última semana se me notificó que la OAH decidió a favor de LAUSD en mi caso 3 años estancado, lo que es algo que he esperado , dado el poder político del LAUSD y sus 7000 millones dólares del presupuesto repleto de conexiones políticas . Citando a John Lennon, " gritos de Dinero . " Ahora me queda más que apelar esta decisión para mí y para los cientos de maestros que ya están en el LAUSD olvido legal expresa y los que pronto seguirán en la empresa antes de lo previsto la privatización de LAUSD y la educación pública con fines de lucro , junto con el embrutecimiento de los electores a un punto en que no tienen suficiente educación para la comprensión de lo que está pasando para oponerse a ella.

Dada mi contribución financiera ya importante , además de la liquidación renunciado , espero que usted considerar seriamente invertir en mi caso , por lo que nos podemos permitir los procesos legales costosos que se ciernen por delante tanto en tribunales estatales y federales. En la actualidad hay algunos abogados dispuestos a asumir estos casos y aplazar gran parte de sus horas facturables , pero el de los bolsillos de abogar enérgicamente en nombre de los profesores que han sido objeto va a costar.

Si somos capaces de ganar, va a establecer precedentes legales para defender a otros profesores ya destinados para la terminación o aquellos que pronto lo serán . También podría reabrir algunos de los cientos de casos en contra de los maestros que el LAUSD ha ganado ya, porque nadie ha tenido el dinero y el compromiso de combatir eficazmente la espalda. Si LAUSD y los individuos dentro de ella son finalmente responsables por su comportamiento ilegal , quién sabe , que sólo podría detener o por lo menos llegar a ser significativamente disminuido .

Otra cosa que usted puede ser que considere está votando por mí como una escritura en la Presidencia de Maestros Unidos de Los Angeles en las próximas elecciones de febrero de 2014. Vale la pena mencionar los siguientes hechos :

1 . UTLA no sólo no ha hecho nada para detener la cacería de brujas contra los maestros , en realidad se ha facilitado por ir adelante y no decir nada que LAUSD viola el Convenio sobre la negociación colectiva , sus propios boletines y tanto la ley estatal y federal en su guerra contra los maestros . O para citar de UTLA Roger Scott en mi oído Skelly sucedáneo , "No hay debido proceso aquí . " Es cierto Roger , pero hiciste algo al respecto?

2 . Presente UTLA Presidente Fletcher y el otro fuera del salón de clases oficiales del sindicato fueron elegidos en las últimas elecciones por sólo el 17 % de las bases debido a la completa apatía maestro sobre el hecho establecido hace tiempo que UTLA no hace absolutamente nada para abordar con acciones proactivas para hacer frente a LAUSD guerra corruptos en los docentes con un enunciado claramente el plan UTLA de acción frente a las acciones del LAUSD diseñados para la destrucción definitiva o emasculate completamente la unión . Hemos pasado de más de 42.000 miembros del sindicato de maestros y sus abonados, a menos de 30.000 y soltar. Sin embargo , Fletcher dice que UTLA no actúa, porque no tenemos cuotas ?

3 . Alex Caputo -Pearl representa más que otra facción de los negocios - o la falta de las mismas , como es habitual en UTLA . 4 . Una protesta contra escritura en la votación para mí tiene una mejor oportunidad de proteger a los maestros de manera que la unión se supone que es porque voy a trabajar con los colegas para definir claramente lo que significa para UTLA y está dispuesta a luchar, en lugar de esperar a reaccionar a última atrocidad de LAUSD , que siempre es una estrategia perdedora . Ningún sindicato profesional de éxito permite a su empleador para definir lo que significa. Un liderazgo sindical proactiva con una plataforma claramente enunciado y aplicado pondrá fin a la apatía que está matando UTLA y sus miembros.

If you have to put the article in Spanish, it makes one wonder about the quality of teachers in the LAUSD.

LAUSD has at least a 73% Latino student population. In a district like LAUSD, which clearly gives no value to this now majoritary Latino student constituency and their families throughout our city and state, It would seem to me that making students and their parents aware of just how little LAUSD cares about Latino children and their targeted dedicated teachers might succeed in creating an alliance that finally allows Latino students to receive the excellent public education they are entitled to, instead of the empty edspeak rhetoric that has no support in an objective standard of objective measurement of achievement.

If Spanish as well as English can help students and their families and teachers get together- with the help of bilingual communication if necessary- they might just be able to finally hold the corrupt administration running LAUSD accountable. It's been over 40 years since the Latino walkouts and Latino education today is worse than it was back then. We commemorate the 60th anniversary of Brown vs. Board of Education this year and still have an LAUSD public education system that is 90% Latino and Black and significantly more segregated than it was when Brown said "separate but equal is inherently unequal" in 1954. Ya basta!

The world desperately needs more people like you with the courage, intelligence, and integrity to stand up against the rotten and toxic school bureaucracy and champion the needs of all students, especially those who have been passed along and ignored. Teachers also need you more than ever.

You definitely have my write-in vote for the job of President of UTLA!! I will work to help your campaign anyway I can.

Lenny, sorry to hear that this corruption is continuing against you and so many of our colleagues. Your blog has helped me in so many ways to understand what happens when false allegations are made against you. Yes, most teachers feel that it will never happen to them and I hope it doesn't but for those of us, wrongly accused, wrongly terminated, I will finanically contribute to this effort. I don't have much but I seem to be able to give UTLA dues every month for nothing.A monthly contribution to this cause can start the process.
