As the pro forma United Teachers Los Angeles (UTLA) elections move into their final round of insider trading, why is it that the teachers these jokers have already failed to represent for the last 3 years aren't demanding their heads...or at the very least, some answers? With a voter turnout of less that 25% of those eligible to vote, the answer is simple: LAUSD teachers are so demoralized from past tolerated abuse by LAUSD and UTLA that they don't think anything else is possible and don't believe that the corruption in UTLA can ever be turned around. Hopefully what I have to say might change their minds and get them behind the legal action necessary to finally compel their union to act on their behalf. Clearly, this is a sine qua non to being an effective teacher at LAUSD- knowing your union's got your back.

Over 2 years ago I brought a lawsuit against UTLA and their law firm Trygstad, Schwab & Trygstad for a 40 year-old incestuous relationship they have had without even the benefit of a written agreement- where the interest of the union leadership and staff has clearly been put above the legal duty owed to teacher members of the union. As a non-profit corporation that is supposed to advocate on behalf of their rank-and-file, has UTLA leadership or regular staff ever made the teachers they are supposed to represent aware of the law suit I have brought, even though as a non-profit they have an absolute fiduciary duty to disclose all material facts effecting the operation and potential viability of this UTLA non-profit corporation?

Given officers, staff, and entrenched insiders that are only looking after their own  interests to the clear detriment of teachers- President Warren Fletcher was compensated $100,751.00 in salary and added to his salary in 2012 was other compensations of: $22,582 They did not have this for 2011. This gave Fletcher a compensation package of $123,333.00 and one cannot be sure that that's all, since there has been no independent audit of UTLA's books. And as if this wasn't enough, UTLA employee Carl Joseph, who was disbarred in 1989, made approximately $148,335.00 and $73,000 in perks for a total of $221,335.00- that's close to twice what Fletcher made. And one must wonder what other compensation and severance packages these folks have?

So let's talk about some ways these morally challenged people can be held legally responsible:

1. Errors & Omissions insurance is for the officers. In order for errors and omissions and malpractice insurance to be valid, there must have been at least some good faith attempt by UTLA officers to keeps rank-and-file informed about things like my lawsuit or other basic obligations that go with being a UTLA officer-fiduciary. How much avoidable and normally insurable liability is being incurred by UTLA officers for utter nonfeasance on their part?

What are the requirements for a member to access the legal defense fund, that UTLA leadership talks a great deal about, but which we have been totally unable to get any response about during our deposition of UTLA Treasurer Arlene Inouye, who was supposedly the "most knowledgeable" person as request by our deposition. She knew nothing. Requests to President Fletcher and others at UTLA have been systematically ignored. Does this negate their malpractice insurance?

2. The UTLA Legal Service Committee is supposed to go over individual teacher claims for assistance, when requested for help by the teacher. Who is on this committee? What are the rules/standard by which claims are judged? How is a teacher supposed to file a claim? None of these issues are presented either to a targeted individual teacher or to rank-and-file in general. Is this a level of gross negligence that goes beyond what a malpractice-errors and omissions insurance policy might cover?

3. Given this alleged malfeasance by UTLA officers, staff, and some entrenched committee members, who does the law firm of Trygstad, Schwab & Trygstad represent? Is it the union, the officers, the employees or teachers. Given the potential for conflict of interest between the duties owed to UTLA as their client of record, what has this law firm done to address this conflict of interest? Have they advised teachers to seek other independent counsel in the likelihood that the interests of their primary client UTLA might be adverse to those of officers, staff, or teachers? This becomes rather difficult when one realized that Trygstad, Schwab & Trygstad have "represented" UTLA for 40 years without any signed agreement. They also make it a matter of standard operating procedure to first tell teachers who come to them for help that "UTLA is our client and your not- we are just walking you through the dismissal procedure." But UTLA refuses to give these targeted teachers any money for legal representation by any lawyers others than Trygstad, Schwab & Trygstad. Even the agreement that Trygstad, Schwab & Trygstad have prospective teacher clients sign waives confidentiality when it comes to divulging the teacher's information to UTLA- an entity that clearly has a potential adversarial interest with the teacher they have failed to protect. On its face, this appears to be a clear conflict of interest and potential malpractice.

4. Complaints, an audit, and complaints to appropriate state and federal regulatory agencies appear necessary to reconstitute the union on a more member friendly basis, free of the endemic self-dealing that has permeated UTLA for so long and made possible LAUSD's witch hunt against teacher that UTLA continues to fail to defend. If Warren Fletcher and Alex Caputo-Pearl are now talking about no longer standing for the incarceration of teachers without due process of law, isn't it fair to ask why they did nothing over the previous 3 years, when asked by clearly innocent and dues paying members for the help they so justly deserved? Why would the next 3 years be any different?

All legal actions to stop these and other outrageous behavior by UTLA and LAUSD have one thing in common: A complete and utter lack of due process of law that has up until now allowed teachers to be deprived of "liberty and property" - and in some cases "life" without any formal adjudication of guilt in a neutral legal forum, that presumes they are innocent until being proven guilty by a preponderance of the evidence, and with those charging the teacher having the burden of so proving.

If you have finally realized that this nightmare is not going to come to an end until those perpetrating this on teacher, students, and parents are stopped by a court with the jurisdiction to do so, is now the time to finally take legal action. Continuing to rant about injustice to people who are increasingly empowered by a UTLA and teacher rank-and-file's inaction is a formula for disaster. Si finalmente han dado cuenta de que esta pesadilla no va a llegar a su fin hasta que los que cometen este de maestro, los estudiantes , y los padres son detenidos por un tribunal con jurisdicción para hacerlo, ahora es el momento para finalmente emprender acciones legales. Continuando a despotricar sobre las injusticias a las personas que tienen el poder cada vez más por un UTLA y la inacción maestro de rango y archivo es una fórmula para el desastre. What wears confronting is a profoundly lawless movement of corporate a and careerists driven by an addiction called greed. There is no stopping them by the lawful and ordered methods we used to vaguely rely on for some modicum of justice. Their corruptionis a corrosive growth. Good people will wallow in the filth with the administrative evil and CEO personality disorders and while they are in the schools you can certainly anticipate that students will learn more from this nightmare than anything g wer allowed to reache them thanks to these pirates of plutocracy and their bagmen. The union is merely a thuggery , and it's banned your ass from its HQ . I am impressed . They do their best to ignore is. I dunno what they thought was going to happen when there were so many of us fired we figured out that our power is not human power and we Ain't LAUSD. We are teachers and they will rue the day they fucked with us.

All we have to do is tell the people . It is harder tha it sounds . I am no Mosche the Beadle , but I do not truck with these devils
Enough of us file lawsuits , the courts will have to do a lot more than ignore us . did you see Josh P issued a speech about the billionaires? How long we're they going to wait!? When Randi Weingarten is ordering teachers to snitch on each other in Huff Post. The jig is up. Maybe unions have to go but so does the administrative evil and the undue influence of billionaires . We don't need those test so we don't need the god damned money. Adios.
Give us back our schools !
We can sue Bill Gates . We can demand that they prosecute Broad. And by the time we are through, the Walmart demographic will be shopping at Kmart.
