LAUSD and UTLA Collude to End Collective Bargaining and Civil RIghts for Teachers Part 1

If you are a teacher for the Los Angeles Unified School District (LAUSD) you have no civil rights and no union rights. LAUSD may target you for removal, because you either refuse to go along with the longstanding and highly profitable financial scam they have been running for generations now called public education, aka minority daycare.

It is being played against predominantly students of color in a school district that Whites abandon long ago (only 6% left in LAUSD), making it more segregated that it was prior to Brown vs. Board of Education in 1954. Or if you are just "guilty" of having a great deal of seniority, which puts you high on the salary scale, you can be removed from teaching with no collective bargaining rights and especially no arbitration as guaranteed by the LAUSD/UTLA Collective Bargaining Agreement, which is now systematically ignored, even if UTLA voted for it. By merely adding a gratuitous morals charge under California Education Code 44939.odt, a teacher can even be stripped of their Collective Bargaining rights to grievance and arbitration. This war against teachers started in 2006 when present chief LAUSD attorney David Holmquist was director of the LAUSD Office of Risk Management and Insurance Services. With  2006 Retiree Health Actuarial info.pdf, it became open season on older high-seniority and better paid teachers who either suffer from good teaching or honesty in the face of endemic LAUSD/UTLA corruption.

In the case of thousands of media-made-invisible LAUSD teachers who have been removed from their livelihood without honest cause, they are put through a series of pro forma meetings, where the results are predetermined and those representing LAUSD will admit that they have never even read the responses to the knowingly false charges being brought against you, since LAUSD's sole motives are to get rid of teachers at the top of the salary, about to vest in lifetime health, or who are disabled.

Furthermore, there will have been no investigation- other than talking to the principal who was encouraged by their superiors at LAUSD to bring the charges against you in the first place. The truth of charges is really never at issue, since your responses are never read and the finds of your "due process hearing" is written prior to the hearing. After an ersatz Skelly hearing that in no way respects the rights that the Skelly case is supposed to insure, your name is submitted to the LAUSD Board for termination as a teacher without any proof being offered of the bogus and self-contradictory "evidence" being offered against you or even a minimal according of fundamental notions of due process of law..

While this might seem to be a pretty extreme statement, I think Richard J. Schwab, esq. of Trygstad, Schwab, and Trygstad put it best when I first met him on November 17, 2010 on the occasion of my own dismissal proceedings that had just been rubber stamped by the LAUSD Board. At that time he said,

"You have no civil rights, you're chattel to LAUSD."

Attorney Schab, a partner in Trygstad, Schwab & Trygstad, seems to have an exclusive license to see to it that you are removed from employment at LAUSD in a manner that will be least strenuous and costly for LAUSD, while making their law firm a fortune as the only law firm that teachers union UTLA will pay any money to for your defense in a process where Schwab and Co. start out by assuming you are guilty of all the outrageous fabrications that LAUSD has made up against you.

Hell knows an attorney can make a great deal more money coercing you to cop a plea to something that you didn't do, rather than having to get themselves involved with the tedious business of actually advocating on your behalf. That and falsely telling teachers that their CALSTRS retirement, benefits, and unemployment are at jeopardy, when they are not, get most terrified teachers to roll over and resign or retire.

And aggregating all of the bogus cases against all teachers falsely accused or sitting in rubber rooms around the district or on unpaid leave into one claim against LAUSD or seeking equitable relief in the form of an injunction, according to Richard Schwab, "Would be a separate action," which he and his law firm will not engage in on your behalf with the money supplied by UTLA, unless of course you give him a sizable separate retainer. It doesn't take a Rhodes scholar to figure out that getting as many innocent teachers to cop a plea is far better for his law firm's bottom line than actually having to litigation on their behalf.

If you point out to either UTLA or Trygstad, Schwab & Trygstad that they have a potential conflict of interest and that targeted teachers should be allowed to take any money that UTLA rarely and begrudgingly gives for your legal defense to another attorney, UTLA and Trygstad, Schwab & Trygstad will deny this vehemently and UTLA will tell you that they will not give the money to any other attorney. Ironically, this unwillingness to allow a dues-paying UTLA union member under siege by LAUSD to pick their own defense attorney is probably the best proof of the conflict of interest, since UTLA as of this writing has been unable to state what interest they have in determining who advocates on your behalf- something Richard J. Schwab esq. also seems loathe to do.

Present AFT President Joshua Pechthalt wrote me, when he still worked for UTLA, an email on November 3, 2010: "Leonard, the legal services committee will take this up and get back to you asap Josh." I'm still waiting for Joshua Pechthalt or anybody else from UTLA to get back to me. It is worth mentioning that because of this blog, I am contacted on a weekly basis by teachers who are being subjected to removal from LAUSD who have also been told by Trygstad, Schwab & Trygstad that they have no case and should settle.

Proposed Rule 1.7 of the American Bar Association dealing with conflicts of interest clearly states that the client's consent must be obtained prior to representation and, in addition, where the fees of the client are paid for by a party other than the client, the client must sign a waiver. Attorney Schwab had no signed agreement for my representation and no signed waiver, but that did not stopped him from continuing to sell me out to LAUSD until last Friday, June 17, 2011, when I received a letter from him stating that he was withdrawing as my attorney. I guess he was finally able to consume the $15,000 that UTLA had given for my "defense." But that will have to be the subject of future posts on this subject.

In meeting with Deborah Esaghian, esq, back in 2011, an associate of Attorney Schwab who passed the bar in 2006. She made the most telling remark about where Trygstad, Schwab & Trygstad stand in terms of defending teachers, "I would never send my children to an LAUSD school." So why would a union like UTLA have attorneys who clearly care so little about public education and the teachers doing the thankless job of trying to teach with no support and hostility from LAUSD administrators, UTLA, and its attorneys? It is worth mentioning that Ms. Esaghian's employment at Trygstad, Schwab & Trygstad shortly thereafter came to an end and she when out on her own to practice law. But UTLA will not give her any money to defend targeted teachers, which remains the sole 40 year fiefdom of Trygstad, Schwab & Trygstad.

Susan studied literacy education, English literature, and fine arts and holds a BA ('63) and MS ('65) from Brooklyn College, and has the equivalent of two master's degrees, earned in graduate studies of literacy, arts and education. She taught literacy skills and art, for four decades in NYC in elementary and secondary school.  In 1998 she won the New York State English Council (NYSEC) Educator of Excellence Award  for her successful teacher practice, studied by Harvard  and the LRDC at the University of Pittsburgh for the New Standards research. At the end of her research, her unique curriculum was selected by the LRDC to be used in their national staff development seminars for school superintendents. She was among six teachers -- from among the thousands across the nation-- observed during the research project, and her teaching practice met all the  principles of learning. In the nineties, she rose to prominence in national educational circles, while teaching at a new magnet school, East Side Middle School. The reading scores of her seventh grade students were at the top of the city, and on the first ELA, which two thirds of city students failed, her former students (then in the eight grade) were TENTH IN THE STATE.

 She writes often about what she learned about the genuine standards for learning, in an attempt to begin a national conversation about the authentic standards, so that there can be genuine reform. Her experience that ended her fine career in the NYC Public Schools has led her to write about the process that removed the top educators, silencing the voices of the classroom practitioners who would not accept anti-learning policies. "I know first hand the financial, personal, emotional and physical damage that can result when school administrators, the Montana Education Association and the National Education Association put their own interests above the students, teachers and the taxpayers of the State of Montana My files contain mountains of paperwork including depositions, declarations of truth, notarized documents and exhibits resulting from an arduous legal process that finally ended when the Havre (Montana) School District settled two lawsuits - a Federal suit and one filed in State District Court. These documents also include a letter from a union representative stating, " This is nothing more than a witch hunt." Yet the union continued to allow the school administration to harass, bully and bring harm to me.
These two lawsuits resulted from a single incident that, had it been handled differently and under the light of public scrutiny, would not have snowballed into awards of more than $200,000 worth of damages. Funds that eventually came from the taxpayers' pockets. Ironically, as a taxpayer in Hill County, my family and I are helping to pay for the damages awarded to me. This covered the attorneys' fees. The settlement did not include my attorney fees, however the district, insurance and taxpayers paid the defendants attorney bills, which exceeded mine. The settlement was made on March 2, 2006."

This is what happens in a country when the real people who bring the house down never see jail time, or even some accountability in the workplace!  The microcosm of the school bureaucracy  is identical to the macrocosm that is the political institutions. Top-down destroys the show and the guy at the bottom is blamed.

know I was the celebrated NY State Educator of Excellence by all rubrics, student scores, parents assessment and the National Standards research.

 I have a little but fascinating story  to relate, one which demonstrates how the process in this article worked when I experienced it -- 16 years ago, when I had no idea that despite my fame and excellence, nothing I could do could save my job, or prevent them from shredding my reputation. I was blind-sided, but 16 years later  I know a hundred thousand teachers  were removed, and are still being subjected to the process that has become the way to REMOVE  the veteran teacher so the schools will tank! 

So,if you wish to know the TRUTH about why the schools are made to fail, read on! "You see, no law or contract could prevent them from accusing me of some criminal behavior that could remove me without a hearing! There was (and is)  not  a shred of accountability for lies, for slander and sleight of hand, let alone for malicious intent. DUE PROCESS DOES NOT EXIST IN THE SCHOOL WORKPLACE. PERIOD! " We see how that worked in the financial world and the mortgage system.
Simply put, the Superintendent HERSELF used an allegation of verbal abuse (a child said I called her "names' in front of a class) to WRITE A LETTER  which said that I was found guilty of corporal punishment" That  was her own invention in the "letter-posing-as- verdict' and she refused to let me know the names of the 2 13 year old accusers, or to see evidence. 

As Lenny describes, I never saw a charge or even knew this was in the works, and yet I spent 6 months in a teacher jail at the District Office, while  back at the site, the principal trashed my famous practice and celebrated curricula, and distributed all my books and materials to other teachers" this,  in the top Manhattan middle school--the one that I had put on the map by attracting the Pew National Standards research TO MY CLASSROOM.

When the union failed to protect me, and it looked as if I would have to go the route of waiting years for a hearing -- while all the witnesses to my practice and my excellence disappeared -- I hired an attorney. For $25,000 he filed a lawsuit and made it clear that even if I had said such a thing, it was NOT corporal punishment; "Send her back!" he ordered to the DOE and everyone, and he warned: DO NOT MENTION THIS SLANDER ,AND REMOVE IT FROM THER EMPLOYMENT FOLDER. They did tell everyone, and they put it in my employment history. They did SEND ME BACK , but not to my practice. 

I was ordered to become "pull-out- teacher, (something that had never been a part of our school's organization) and  with no instructions, I was housed in a filthy  storeroom, where a handful of students  met with me. I had no curricula, no locker or supplies. The new principal, a former district curriculum director (who knew me well for years) now "documented' my incompetence, telling me when I objected. "That was then, this is now!" 

Charges were put out for INCOMPETENCE, and my employee folder EMPTIED OF 4 decades of excellent evaluations, letters of praise from principals, awards ("Who's Who" and the NYSEC award) and the letter that she wrote only a year ago, lauding me for some professional seminar.

But here is an incident, that will show the malicious intent of the humiliation of a teacher of quality such as myself, this principal --who as A Fordham University professor had placed her student teachers in my practice to study with me -- this trusted staff developer who knew me well, persuaded a teacher in the school downstairs (in our building)  to write a letter saying that "she had heard me "threaten to kill' her." I was thrown out that next day.All this occurred 4 months after my expensive attorney had returned me to the school, 
Wow, from famous educator to potential child molester and murderer.

ME! Why, beyond the directive to remove my salary from the budget and my voice from curricula decisions concerning testing that would replace learning?
Livid that parents in the neighborhood (the EAST SIDE of Manhattan) clamored for my return to the classroom, she needed (as Lenny's essay points out) a criminal allegation!"  POOF! I was "disappeared'. 

The Director of Personal who delivered the letter with the slander, knew me as a celebrated teacher,  disassociated herself with the paper. "I had nothing to do with that!" She slammed it on the table  of the rubber room, to which I had reported, and ran!

 But the IMPACT of such unethical tactics -- the humiliation that I suffered for several years which haunts me still -- was the direct result of being powerless, because the union rep, (whose name I will not publish here,  as the UFT has seen my evidence) "Don't worry the principal is always believed," he was heard saying to the principal.

This lawless process is the very one that removed the voices (not merely  the salaries) of  the dedicated, experienced, educated and successful veteran teacher-practitioners in schools across America, so the public could be  bamboozled!
Thus, charlatan reformers could take over the national narrative, and give the schools to the private sector to plunder at will.

For myself, Attorney Schwab never sent second bill, when he did over 3-years later --a non-retainer agreement "transportation" charge of $41 for 7/12/07 (missed dated for 7/11/07) was added to second bill but the date was due on the first bill.

I was billed 4.7 hrs ($1,292.50) by Schwab even though he only met w/ school police for 45 minutes (approx.) on 7/11/07 and spent time talking on his cell phone re: another case.

I was never credited a free half-hour by T, S, & T as a UTLA member ($137.50).

Schwab (commingled) charged for a phone call to "client" on 7/24/07 which never took place.

Schwab (commingled) charged one hour ($275) for a 7-minute phone call and to read a 3-page letter on 8/01/07.

I spoke w/ Schwab on 8/07/07 for 23 minutes (w/ secretarial transfer) but Schwab claims he then spoke w/ a police detective for another 2.07 hrs on the same day (commingled billing). Do police detectives have that much time to talk to a lawyer, especially about a straight forward matter?

A second non-retainer agreement "transportation" charge of $44 for 8/16/07 was added to second billing.

Schwab never obtained a police report from LAUSD police for the matter in which he was hired, said alleged violation of Ed. Code #49079 by LAUSD Administrator.

Why hasn't anyone reported these lawyers to the California bar association?

One of the reasons why certain morally challenged and exclusively money-motivated lawyers and other people have been able to get away with this level of corruption is because the regulatory agencies like the State Bar of California, the California Department of Education, the State Attorney General, and California Teacher Credentialing are either inundated with complaints or have chosen not to act because of political pressure behind the move to privatize and dumb down public education. Literally hundreds of complaints have been filed with EEOC and DFEH, which up until now have not had the budget to investigate or desire to prosecute blatant corruption at LAUSD/UTLA.

As Americans, we assume that the judicial branches of both our state and federal government will protect us by applying fundamental constitutional rights and clearly defined legal obligations that entities like LAUSD continue to trample on with no consequence. We are presently in federal court with the hope that some modicum of honesty remains in our system. In the not too distant future I'll let you know whether I am naive or whether we are finally successful in stopping the privatization juggernaut.

Welcome to the world of "due process" for teachers, which doesn't exist and never has.

Collusion galore happens between a "union," its law firm, and a school district. A teacher doesn't have a prayer of winning, especially when administrative law is written in such a way that practically anything goes in a teacher termination.

A principal can do whatever the hell he or she wants, and there is little a teacher can do about it. Even if that teacher is in a protected class such as age, gender, religion, or FMLA, there is little recourse as lawyers are reluctant to take teacher termination cases.

Thank you for your comment. It is my belief that this sad state of affairs continues because teachers, who know about the corruption in LAUSD and UTLA, are too justifiably terrorize to stand up and speak. As teachers, we know that unless students have consequences for negative behavior, it is impossible to teach. The same thing is true with administrators at LAUSD and UTLA. Federal law has a provision that any entity engaging in age or any other kind of discrimination covered by federal statute will lose all their federal funding. That sounds like a consequence that even the corrupt and self-serving folks at LAUSD and UTLA can understand. There is strength in number, if the majority- teachers- are willing to talk. Initially, it might have to be anonymously, but ultimately we might just be able to teach in a system of public education with two-way accountability for all that will be better for all concerned- even the administrators.
