ESQUITH CASE: LONG OVERDUE LESSON FOR LAUSD?

There continues to be a great deal of rewriting history at the Los Angeles Times and the Los Angeles Unified School District (LAUSD) to make it seem that teachers only got targeted after Miramonte to protect students. That outright lie is at the root of LAUSD chief attorney David Holmquist's incessant comment also echoed by Superintendent Cortines that, "We will always put student safety first, when dealing with teachers, which is why we are so cautious in dealing with alleged teacher impropriety." One need only look at the frequency and number of individual cases against teachers long before Miramonte to expose this lie. The figures show that the war against teachers and the huge number of teachers forced into retirement or brought up on fabricated charges started in earnest after then LAUSD Director Office of Risk Management & Insurance Services David Holmquist published figures in 2006 showing that teachers at the top of the salary scales (93% of all charged teachers), were pushing the District into bankruptcy. Something had to be done and LAUSD chief attorney did it, despite the necessity of trampling on thousands of teachers civil rights.
And of course, none of this illegality would have been possible if our "free press" had just asked the same questions I'm posing here. The L.A. Times and other supposed news media have scrupulously avoided doing so by continuing to muzzle their reporters, who are never given the green light to follow the facts and the money. With the now targeted renown master teacher Rafe Esquith might LAUSD's premeditated illegal actions finally see the light of day?
I have talked with many reporters at both the local and nation levels with far greater daily access to LAUSD and other districts like it around the country than I will ever have and to a person they say, "We know what's going on, but we can't get that story past our editors." Why? Because the same people monetizing and privatizing public education now directly control or outright own our "free press." This is why there is never a mention of the $60,000 a year LAUSD saves for every teacher at the top of the salary scale they target and get rid by fabricating false morals charges under California Education Code Section 44939.
With the targeting of nationally renown teacher Rafe Esquith, there is finally too much publicity that cannot be swept under the carpet in the process of getting rid of teachers whose only "crime" in the vast majority of cases is that they were at the top of the salary scale with expensive benefits.
Remember, as admitted in sworn affidavits, LAUSD Board Member Richard Vladovic stated in public, "The LAUSD Board has always voted for the dismissal of teachers based exclusively on [unverified] charges without any evidence presented to the Board," even though both California Education Code, applicable cases law, and the U.S. Constitution clearly call for evidence offered under penalty of perjury. You can't get a speeding ticket without the officer signing the ticket under penalty of perjury, but LAUSD with the tacit support of the media and the courts have been able to take away a teacher's profession without ever having to have hard evidence of wrong doing sworn to by those bringing charges against the teacher.
Clearly, there is a degree of reticence for those fabricating charges against teachers to perjure themselves, but so far they haven't been required to do so- they just rubber stamp unverified charges and summarily remove the teacher. This has created a situation where teachers are presumed guilty until they prove themselves innocent, which is next to impossible in a purposefully protracted process that is allowed to go on for years, while teachers are deprived of salary and benefits before there has been any adjudication of guilty in a neutral forum of law as is their constitutional right.
Are there pervert teachers? You bet. In any profession where there is increased access to children the number of pedophiles is greater- but no greater than it was before Mark Berndt was finally discovered after being allowed 18 years of unfettered access to his student prey. If one were to dispassionately look at the real facts dealing with the removal of teachers without due process of law it might become crystal clear that deviants like Mark Berndt could only survive because their administrators were too busy going after exemplary teachers like Hobart Elementary's Rafe Esquith.

Esto ha creado una situación en la que se presumen culpables maestros hasta que demuestren su inocencia, que es casi imposible en un proceso deliberadamente prolongada que se le permite continuar durante años, mientras que los maestros se ven privados de salario y los beneficios antes de que hubieran existido adjudicación de culpable en un foro neutral de la ley como es su derecho constitucional.

¿Hay pervierten los maestros? Usted apuesta. En cualquier profesión donde hay un mayor acceso a los niños el número de pedifiles es mayor-, pero no más de lo que era antes de que Mark Berndt fue finalmente descubierto después de que se les permita de 18 años de acceso sin restricciones a su presa estudiante. Si uno fuera a mirar desapasionadamente los hechos reales relacionados con la eliminación de maestros sin el debido proceso legal que podría llegar a ser claro que los desviados como Mark Berndt sólo podían sobrevivir porque sus administradores estaban demasiado ocupados persiguiendo maestros ejemplares como Rafe Esquith de Hobart Primaria.

I had to learn the hard way that teachers have no real protections at all, and this is true everywhere in the country with maybe the sole exception of NYC. I never knew until I was kicked to the curb that I needed access to an outside lawyer because the "union" (I was in Nevada) was totally worthless and colluded with the district.

Sadly, NYC is not the "sole exception." Just ask Francesco Portelos or Sue Lee Schwartz who like the thousands of targeted teachers at LAUSD have lost their jobs. This privatization of public education is a nation phenomenon- just ask Karen Horwitz from Chicago whose National Association to Prevent Teacher Abuse has several thousand members of targeted teachers- many of whom were highly competent nationally board certified, when their respective districts went after them for the sole "crime" of being at the top of the salary scale.

As hard as this is to believe, they went after Esquith for the simple reason he fits the profile of being over 40 and at the top of the salary scale. Since the bullies at LAUSD have received no push back from 14,000 teachers they've already gotten rid of or UTLA for mass firings over the last 9 years, they continue to target and wholesale remove any teacher who fits the age and salary profile, since they know that they will save $60,000 in just the first year these teachers are gone and replaced by fresh-out-of-college "teachers" on emergency credential paid $35,000 and less expensive benefits..

What bothers me is the ignorance of the majority of teachers about the absence of legal protection with their union. I admit that I had no idea that my union had no legal protection when I placed myself in a position to be harrassed and falsely accused after becoming a chapter chair. I championed the cause of teachers as specified in the CBA and felt that the union had my back. Little did I know that when they target you, the union will do nothing for you. Be you chapter chair, regular union member, you get no legal help. An injury to you is your injury because you have no legal protection.If you're like the majority of teachers, you have no additional funds to hire an attorney to defend you. You literally are forced to resign or retire.UTLA is a fake union because, unlike other unions its size and mandated with its same purpose, it provides no legal protection and it doesn't enforce its CBA. Oh, for a few selected teachers they'll make a show of doing something but it will amount to exactly nothing. They will posture and say all the right things to the media and then do nothing, In earlier high profile teacher jailings, it wasn't the union who forced the teachers back into the classroom, it was their students, parents and community who demanded it. In the latest case of Esquith, its his attorney that is representing him, not his union. That speaks volumes about the effectiveness of UTLA.

Ca Ed Code 44939c is always violated. The charges are never verified. In the chronology of events the district must first violate 44660, 44664, and 44031 (personnel file notice) to get to 44938 or 44939. If you have been terminated or brought up on charges via 44939 there is a good chance the district had a secret personnel file on you that they had been keeping for some time. See Miller vs Chico 1979, and PERB Decision Novato #210.

PERB doesn't enforce ed code violations. This is why I went 2 weeks ago to literally scold the PERB 5 judge panel on this issue. If you are a teacher you have NO RIGHTS under the ed code. Only Superior, Appellate, and the Supreme Court can enforce ed code rights. But first you have to exhaust your remedies with PERB!

This is part of the treason of State Senator Rodda who wrote the legislation that created PERB in 1976. Teachers sacrificed ed code protections for the right to collective bargaining. BIG MISTAKE.PERB and EERA don't supersede the ed code, but they don't enforce it either !Unions are suppose to lobby for ed code protections and collective bargaining and CODIFY both under the contract. Teacher Jail can only exist because of the absolute corrupt collusion of the unions.The district uses the punitive parts of the ed code,knowing full well teachers aren't protected in the contracts... Keep up the good work Lenny, the fight continues..
