UTLA: A "UNION" THAT AMBIGUOUSLY FUNCTIONS AS AN EXTENSION OF LAUSD

Every week for the last 5 years I have been contacted by what seems to be a neverending parade of targeted senior teachers at the top of the salary scale that make up 93% of teachers being charged and subsequently removed from their careers at LAUSD. They all tell with minor variations the same story: They are being hit with fabricated morals charges or inflammatory allegations of being racist for doing something as mundane as teaching about race in the context of the civil rights movement in a Social Studies class.

They all describe the open collusion of UTLA from chapter chairs on upwards with LAUSD against them in a process that presumes them guilty without UTLA doing anything to come to their aid. The only teachers UTLA has ever defended are those within the UTLA "power" structure. Just ask Alex Caputo Pearl who was targeted when he was at Crenshaw High School and very atypically had the union successfully come to his defense.

What all these teachers describe as being"unfairly targeted by an administrator" equals the LAUSD administrative process of building a file of fabricated "evidence" and charges to ultimately seek your firing or forced early retirement in a process that will save LAUSD approximately $60,000 in just the first year after they have gotten rid of you. And it is worth noting that LAUSD makes no attempt to hide just how disingenuous this process is, since the files of many of these targeted teachers have literally the same paragraphs in them that have obviously been cut and pasted from a script- I even have a copy of the script that was mistakenly put into some correspondence with a targeted teacher. But a targeted teacher without a job or benefits is unable to engage an attorney to defend themselves in the long and purposefully protracted process of fighting back. Maybe that's why they were in a union.

Even when it comes to displaced teachers, many of whom have been displaced without taking account of their actual hiring date seniority and while leaving teachers with emergency credentials still in place in many cases, the goal of LAUSD seems clear. Once displaced, it is virtually impossible to get a fixed position, because clearly LAUSD administrators are being told not to give them to displaced teachers, so that after 3 years they can be fired as employees at will and no longer tenured teachers for having failed to get a regular post.

What follows is a typical email I just received that hits on many of the factors leading to losing ones position at LAUSD. Are teachers so passive as a group that they will continue to do nothing, while their ranks of senior teachers continue to be decimated by an LAUSD/UTLA open conspiracy that makes no attempt to hide what it is doing?

While no one teacher can stand against these criminals, it occurs to me that a concerned and well organized action brought and paid for by the literally thousands of teachers who have already lost their careers might finally bring this criminal conspiracy into the public's awareness. "I have been teaching for 20 years now. I am at a school where I am being unfairly targeted by an administrator. The job is hard enough but when you have administrators writing you up for teaching kids the difference between racism, prejudice, and stereotypes it can be impossible. When it comes to UTLA I am starting to see why some teachers are frustated. Some chapter chairs are in bed with the administration and I wish there would be more push back from the union. Teachers are afraid to talk to each other or to speak. It's really sad to see. The raise was nice but a lot of the teacher harassment is still going on, especially for teachers who are brave enough to speak out. Finally there are also teachers out there who are willing to snitch on their own colleagues for brownie points with their administrators.

I am also a displaced teacher. I am wondering if other displaced teachers are getting the same treatment from their administrators at other schools. Part of the bargaining agreement UTLA had with LAUSD was to place the displaced teachers at schools. I believe that displaced teachers may be labeled as being not effective in the classroom. That is not the case. I'm just wondering if displaced teachers have been unfairly targeted this year since this is the first year of the agreement."

Lo que sigue es un correo electrónico típico acabo de recibir que impacta en muchos de los factores que conducen a la pérdida de las posiciones en el LAUSD. Son los maestros de manera pasiva como un grupo que van a seguir sin hacer nada, mientras que sus filas de maestros de alto nivel continúan siendo diezmada por una conspiración abierta LAUSD / UTLA que no hace ningún intento de ocultar lo que está haciendo?

So true Lenny. This group in control of the Union, made up of old guard conservatives and new ones is foul. Even when Warren was the Prrsident, they Obamaed him, that is they never supported him on any of his efforts and in effect, worked against him his entire tenure as President. Through sweetheart deals with LAUSD like free time for campaigning during school hours, no representation of members who weren't in the inner circle or a relative, undermining of activist chapter chairs and so much more. This current union leadership is definitely in bed with the district to the detriment of its membership. UTLA is so busy catering to charter teachers and signing up on separate MOU's, they can't or won't enforce their CBA with public school teachers . The folly of agreeing to a dues increase is just the march to more ignoring and lack of protection for their rights teachers will continue experiencing.

As familiar as the content of the citation from the targeted teacher is, so is the entire content of this story. It's been told over and over again on this very website for what must be close to ten years any further told on other pages by writers or bloggers even more often. However, just telling it is really only part of the story. You see, the dynamics that allow this to happen are half of the story or as much.
As was mentioned, none of this would have been possible without the cooperation of colluded chapter chairs at the school sites. This was and is a winning practice for the current UTLA leadership under Alex Caputo-Pearl and his union power slate. They knew that only about 20% or union members vote on contract issues and during election years. So they set about rounding up compromised chapter chairs to insure that the power slate would command a majority of those votes. As they did this, it soon became no secret that they were cheating by using sick days to campaign and this went on until the district finally had to put as stop to it. Opposition candidates to the power slate filed complaints with the union election committee to have these cheaters disqualified. However, they soon discovered the this same committee was staffed by power slate members and sympathizers so nothing was done and the power slate prevailed in every office. Wherever there was an inspired and vocal adversary such as David Garcia who ran for the presidency, the power slate made sure that such opposition was unemployed by the district thus terminating their candidacy. And so it went for the power slate.
Nothing has changed so far to today. The union still uses its plants to control teachers at every level. Some of these double agents are well known and held in the highest contempt by those who know their agendas. As as reported earlier, if you read the story, they are the only accused teachers that the union will ever defend and free from detention. Among them are familiar names like Arlene Schery and Scott Mandell who run a notorious impotent union committee for rehoused teachers which does virtually nothing other than existing. Others held in equal contempt like Mike Fuoroli were among the moving forces which put this charade together as a depot for senior teachers under duress to waste away. And to this day, that's what they do.
If you're wondering how all this can come to be, the reasons for it are rather simple. What the district and the union reply upon are seldom disappointed with are indolence and denial. They know that as long as teachers aren't personally experiencing the living hell of ostracism and eventual career ruin, they'll remain aloof to it and only participate vicariously upon occasion. And so, it'll go on until little by little, bit by bit, they're all replaced by cheap labor through charterization or career assassination.
