LAUSD and UTLA Collude to End Collective Bargaining and Civil RIghts for Teachers Part 1

(Mensaje se repite en Español) (For a national view of public education reform see the end of this blog post) If you are a teacher for the Los Angeles Unified School District (LAUSD) you have no civil rights and no union rights. LAUSD may target you for removal, because you either refuse to go along with the longstanding and highly profitable financial scam they have been running for generations now called public education, aka minority daycare. It is being played against predominantly students of color in a school district that Whites abandon long ago (only 6% left in LAUSD), making it more segregated that it was prior to Brown vs. Board of Education in 1954. Or if you are just "guilty" of having a great deal of seniority, which puts you high on the salary scale, you can be removed from teaching with no collective bargaining rights and especially no arbitration as guaranteed by the LAUSD/UTLA Collective Bargaining Agreement, which is now systematically ignored, even if UTLA voted for it. By merely adding a gratuitous morals charge under California Education Code 44939.odt, a teacher can even be stripped of their Collective Bargaining rights to grievance and arbitration. This war against teachers started in 2006 when present chief LAUSD attorney David Holmquist was director of the LAUSD Office of Risk Management and Insurance Services. With 2006 Retiree Health Actuarial info.pdf, it became open season on older high-seniority and better paid teachers who either suffer from good teaching or honesty in the face of endemic LAUSD/UTLA corruption.

(Mensaje se repite en Español) (For a national view of public education reform see the end of this blog post) As somebody who went to law school and taught constitutional law at both the secondary and university levels, I had always operated under the delusion that one was innocent until proven guilty by a preponderance of the evidence in a civil case and beyond a reasonable doubt in a criminal case. In the corrupt world created by the Los Angeles Unifed School District (LAUSD) and United Teachers Los Angeles (UTLA), nothing could be further from the truth. From the moment you are targeted for removal from teaching for what quickly becomes a never ending sequence of fabricated charges based on reasons mentioned in Part 1 of this article, you are presumed guilty by virtually everybody you deal with. And even those few people who see clearly that you are being railroaded by LAUSD and UTLA do nothing to intervene on your behalf, because they are terrified of losing their own jobs...or privileges While there are some pretty awful teachers within LAUSD, ironically, they will be the last to be harassed, attacked, and removed, because they play ball with corrupt LAUSD or UTLA administrations. None of this could take place if UTLA did its job and the law firm of Trygstad, Schwab & Trygstad didn't help in facilitating your removal from teaching by LAUSD. Here is the way it is done:

Taking cognizance of this reality should not get one labeled as a racist, but it does, since doing otherwise would actually require substantive changes to the feudal top-down model of public education that is still entrenched at the Los Angeles Unified School District (LAUSD) and elsewhere in this country to assure that Black, Latino, and poor students never reach their potential. Given the innate curiosity of all human beings, LAUSD and fraudulent school districts like it around this country - that Whites and other affluent people avoid like the plague - can only continue to achieve programmed mediocrity and failure with students of color by continuing to implement a clearly failed model of segregated public education that the Supreme Court of the United States said was inherently unequal 58 years ago in Brown vs. Board of Education.

LAUSD TEACHER WITCH HUNT GOES INTO HIGH GEAR

During the last couple of weeks my phone has been ringing off the hook with teachers telling me the most surrealistic tales of how they have been accused of the most outlandish administratively fabricated actions against them that are being used to build a case for their dismissal.

LAUSD: CONTINUES TO IGNORE CHEATING & CORRUPTION AT CENTRAL HIGH SCHOOL/TRI-C

(Mensaje se repite en Español) (For a national view of public education reform see the end of this blog post) On Tuesday, March 27th, the Western Association of Schools and Colleges (WASC) will send out a team to see how Central High/Tri-C Continuation High School with its 27 stand-alone classroom sites scattered throughout the city is doing 3 years after WASC gave this school a 6 year accreditation. This accreditation is supposed to serve to validity for colleges and universities the high school diploma that this continuation school gives its students. The problem is that the vast majority of the students at this school do not even have rudimentary skills in English and Math, which are the foundational skills they would have needed to do high school level and subsequent academic or trade school work. If, unlike LAUSD administration, you are curious as to how this could be true, realize that even a cursory examination of Central High School/Tri-C classrooms, records, and their practices would substantiate my claims. Alas, up until now, nobody has bothered to look as Central High/Tri-C, which continues to collect Average Daily Attendance money for what amounts to glorified daycare - that is if the students even bother to show up, which many of them do not. So a fair question might be: How did a continuation school where the vast majority of students are far below basic pass and qualify to get a diploma that WASC says meets grade-level and high school graduation standards, when these students lack even rudimentary skills? The simply answer is that they didn't. Worse yet, LAUSD administration has made no attempt to address this continuing fraud that is the rule, rather than the exception, at most LAUSD schools.

They will have formal written charges and you will sign that you received the document (your signature does not mean you agree to the contents--this should be printed under your signature). There is nothing you can say that will help the situation. They have their mind made up. You didn't know it, but your outspoken behavior or desire to improve things put a huge target on your back. In the economic downsizing, principals get target practice. They find a way to formally remove you from the classroom and if they can, charge you with immoral conduct to skip over your collective bargaining rights to grievance and arbitration.

(For a national view of public education reform see the end of this blog post Diisciplinary meetings These meetings are for purposes of discussing something someone believes you have done wrong. It is important that a witness or most specifically, a union representative attend that meeting with you, unless the UTLA Chapter Chair is in the pocket of the principal, which is becoming all too common. Anything said during this meeting can be used against you. You will not be allowed to tape record anything unless you do it in secret. Be aware, in California it is a felony for them or you to secretly record a conversation. During this meeting, you should say only one thing, "I have done nothing wrong. I have followed the district guidelines and I will continue to follow them."

Do not use school email, these communications can be used against you. If you are given a school computer, give it back. If they find or put pornography on it, this will become a charge against you. You have no right to privacy on their property. In fact, do not communicate verbally anymore. Verbal communications are ambiguous and your principal could later bold face lie and negate her verbal information. He/she could claim you didn't understand or you misinterpreted. Insist that any directives be put in writing so you can accurately understand what it is you are being asked to do. This leaves a very important paper trail which helps in your enemy defeating itself.

In this book he demonstrates how your small group could beat a larger army. He argued that you use your carefully planned and timed strength to exploit the weakness of the enemy. In our case, it is the small cadre of teachers versus the vast resources of LAUSD and school districts like it throughout the country. This is intended to give you a heads up regarding the disgusting tactics public school administrators utilize to harass, push you out, stress you out and eventually, if they have their way, terminate your employment (taking your long earned benefits away from you). This knowledge will give you power, especially if you find yourself in a "housed" aka rubber room status.

Up until now, this has constantly created a new and more dynamic synthesis of what it means to be an American. This in turn has made this country and those who make it up more viable than we were before in either our country of origin or in an America without this unique contribution. We as a people are better for this messy and tumultuous process.

Jurupa Unified School District is located in the city of Jurupa Valley in Riverside County, CA. It services approximately 19,000 students and is ethnically diverse. For disclosure, I am currently involved in a group action lawsuit against JUSD, RIC 10015548. Below I have described only a few of the reasons why a large number of employees of JUSD have filed a suit against our district.

The "Rubber Room." It served as a sort of one minute and fifty three second limited spot summary of Leonard Isenberg's last article, "LAUSD & UTLA: THEIR PROBLEMS ARE STRUCTURAL NOT PERSONNEL," in which Lenny articulates the many levels of accountability due to LAUSD and UTLA for the conditions which permit disasters like the events at Miramonte Elementary School and the archaic detentions centers called rubber rooms.

Once we understand this we can take the time and effort necessary to reconfigure LAUSD into a viable form that finally allows this critically necessary institution of public education to get it right. What hangs in the balance is whether or not we will remain a nation that honestly aspires to being "One nation, indivisible, with liberty and justice [and education] for all."

Ironically, it is precisely this district penchant for never taking responsibility that has in fact created the fertile ground for a "culture of silence" he mistakenly ascribes only to teachers, who in reality are too terrorized by LAUSD administration to speak up, when clearly the price of so doing is to be targeted for losing your job.

KUDOS TO UTLA PRESIDENT WARREN FLETCHER, SHAME ON LAUSD'S JOHN DEASY (FELICITACIONES A UTLA PRESIDENTE WARREN FLETCHER, LA CULPA A JOHN DEASY DE LAUSD)

Today, February 9th, on the Pat Morrison radio show on 89.3 KPCC, UTLA President Warren Fletcher finally lived up to his responsibility as the head of a union charged with the protection of predominantly innocent teachers in a a school environment that is safe for all. This was in marked contrast to what LAUSD Superintendent John Deasy and his predecessors have done in their longstanding abysmal treatment of teachers, which in the context of the Miramonte tragedy, LAUSD has been seeking to lay exclusively at their feet.

(Mensaje se repite en Español) (For a national view of public education reform see the end of this blog post) Long about the end of today, the staff at Miramonte Elementary School should have finished packing up their belongings in preparation to be moved to another school. A school with no students enrolled. This is part of what LAUSD has described as an "unprecedented" action to solve for the well publicized crisis at Miramonte. The original staff will be replaced with teachers who have fallen victim to the district's Reduction In Force of last year. As you might guess, this was a tearful emotional event. Some of the teachers had been there for years if not decades. But they weren't the only ones crying. There were parents and students who lamented over why they should lose their longtime teachers over the acts of a few disturbed individuals. Nevertheless, this was the best the rather unimaginative and ill equipped superintendent, John Deasy, could do. He obviously wants to put this behind him ASAP no matter what impact it has on the staff or on what light they'll be cast. Main thing is to offset his administration's blatant lack of due diligence and supervision in this matter and others like it around the district. It's hard to do the job you should have been doing when you were too busy harassing good teachers out of the profession for standing against their own longstanding LAUSD corruption.

(Mensaje se repite en Español) (For a national view of public education reform see the end of this blog post) If you've been watching the news, reading the papers or listening to talk radio at all during the past week, you've heard of the events at Miramonte Elementary School. Two longtime male teachers have been accused of the most reprehensible acts against children and recently a female teacher has been accused of acting in concert with them. To make matters even worse, over the past few days it has been revealed that complaints of the same nature were made against another teacher several years ago, which were never addressed. Needless to say, this story has gone ballistic and has easily been disseminated across the country by now. Parent reactions have been justifiably severe. They include soliciting the services of attorneys, withholding attendance, demonstrating outside the school and making further inquiries. The immediate result has been what's described as an "unprecedented" action by the district superintendent of LAUSD, John Deasy. He has moved the entire staff, both certificated and classified off the campus and by this Thursday, February 9th, he'll have replaced them entirely. So what we should now be asking ourselves is what exactly brought these events about and what are the motivations in the steps taken thus far by the district.

In so doing, Principal Blake has shown a complete and utter disregard for the well being of Alvarado's students, who uniformly describe Alvarado as a dedicated and inspirational teacher, who should rather have been lauded for the difficult job he has gladly done in fulfillment of a vision of public education that LAUSD leadership seems at a loss to achieve.
